BILL NUMBER:S5026 TITLE OF BILL: An act to amend the agriculture and markets law, in relation to a community gardens task force PURPOSE: To require the commissioner of Agriculture and Markets to convene the community gardens task force to issue a report SUMMARY OF PROVISIONS: Section 1. Amends paragraph 1 of 31-j of the agriculture and markets law to require the commissioner convene the community gardens task force. Amends paragraph 2 of 31-j of the agriculture and markets law to require that the task force include 2 representatives from organizations dedicated to the promotion, expansion or protection of community gardens. Amends subdivision (a) of paragraph 4 of 31-j have the task force develop recommendations for developing after school programs relating to after school and to develop community gardens in food deserts. Adds a new paragraph 5 to 31-j to require a report to the legislature and sets forth topics to be included in the report. Section 2. Sets forth the effect date. JUSTIFICATION: A Community Garden is a shared piece of land that is used for gardening by a group of people. Community Gardens have numerous benefits, including access to fresh food with a nutritional

COMRIE -- read twice and ordered printed, and when printed to be committed to the Committee on Agriculture AN ACT to amend the agriculture and markets law, in relation to a commu- nity gardens task force THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 31-j of the agriculture and markets law, as added by chapter 528 of the laws of 2013, paragraph (a) of subdivision 4 as amended by chapter 525 of the laws of 2014, is amended to read as follows: S 31-j. Community gardens task force. 1. The commissioner [may] SHALL convene a community gardens task force to identify and develop ways to encourage state agencies, municipalities and private parties to estab- lish and expand community gardens and the activities conducted by such gardens. 2. The task force shall be chaired by the commissioner, or by such officer or employee of the department as shall be designated by the commissioner. The membership of the task force may include represen- tation from appropriate state agencies and members that represent exist- ing community gardens, counties, cities, towns, villages, school districts, other special use districts, public authorities and cooper- ative extension services. MEMBERSHIP OF THE TASK FORCE SHALL INCLUDE AT LEAST TWO REPRESENTATIVES FROM ORGANIZATIONS DEDICATED TO THE PROMOTION, EXPANSION OR PROTECTION OF COMMUNITY GARDENS. 3. The commissioner, may request the assistance of state agencies to carry out the work of the task force. 4.
