BILL NUMBER:S5031A TITLE OF BILL: An act to provide for the payment of public high cost excess cost aid for the 2008-2009 school year to the Wyandanch union free school district PURPOSE: This bill provides for the expeditious payment of public high cost excess cost aid for the 2008-2009 school year to the Wyandanch union free school district. SUMMARY OF PROVISIONS: Section 1 of the bill requires the New York State Education Department to pay to Wyandanch UFSD the 2008-2009 public high cost excess aid that it is entitled to from the supplemental aid payable during the 2011-2012 state fiscal year prior to the payment of supplemental aid to any other school district. Section 2 of the bill contains the effective date. JUSTIFICATION: The Wyandanch UFSD, through administrative oversight, failed to apply for its NYS Department of Education 2008-2009 "public high cost excess cost aid" worth approximately $1.5 Million. The District is currently facing considerable lay-offs and the receipt of the aforementioned aid in the 2001-2012 school year would allow many of those jobs to be saved. LEGISLATIVE HISTORY: New bill. FISCAL IMPLICATIONS: None. These monies are already designated to be paid by the Department of Education. LOCAL FISCAL IMPLICATIONS: Timely infusion of $1,500,000 to the Wyandanch UFSD. EFFECTIVE DATE: This act shall take effect immediately.

AN ACT to provide for the payment of public high cost excess cost aid
for the 2008-2009 school year to the Wyandanch union free school
district
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Notwithstanding the provisions in subdivision 5 of section
3602 of the education law or any other provision of law to the contrary,
with regard to the payment of public high cost excess cost aid for the
2008-2009 school year to the Wyandanch union free school district, the
failure of such school district to timely apply therefor shall not be
deemed to prohibit or impede the education department from making
payment of such aid in a timely manner. The education department shall
pay such public high cost excess cost aid to the Wyandanch union free
school district for the 2008-2009 school year from funds appropriated
for payment of prior year claims, and such aid shall be paid to such
school district prior to the payment of such funds to any other school
district after the effective date of this act.
S 2. This act shall take effect immediately.
