TITLE OF BILL:

An act to amend chapter 38 of the laws of 1903, relating to the volunteer firemen's benevolent association of North Tonawanda, incorporating the same, providing for the payment of certain taxes and moneys thereto, and for the disposition of the same, in relation to funeral benefits for members of such association

PURPOSE OF THE BILL:

This legislation would remove the $100 cap for the payment of benefits under this act for the North Tonawanda Firemen's Benevolent Association.

SUMMARY OF SPECIFIC PROVISIONS:

Section 1 removes the $100 cap for the payment of benefits under this act.

Section 2 validates prior action taken by the North Tonawanda Firemen's Benevolent Association.

Section 3 is the effective date

JUSTIFICATION:

When the North Tonawanda Firemen's Benevolent Association was chartered in 1903 a cap of $100 was placed on the benefits they may offer their members for the benefit of furnishing relief to disabled members and their families and for the defrayal of funeral expenses.

In October 2014 the Office of State Comptroller issued an audit of the North Tonawanda Firemen's Benevolent Association and it was pointed out that the Association was paying more than the statutorily limited $100 and recommended legislative action to fix this.

Introduced by Sen. ORTT -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend chapter 38 of the laws of 1903, relating to the volun- teer firemen's benevolent association of North Tonawanda, incorporat- ing the same, providing for the payment of certain taxes and moneys thereto, and for the disposition of the same, in relation to funeral benefits for members of such association THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1 of chapter 38 of the laws of 1903, relating to the volunteer firemen's benevolent association of North Tonawanda, incorporating the same, providing for the payment of certain taxes and moneys thereto, and for the disposition of the same, as amended by chap- ter 37 of the laws of 1906, is amended to read as follows: S 1. Herman U. Berger, Charles L. Sommer, Lewis Wattengel, Charles Kohler, August Conrad, William Stuermer, Charles Ray, August F. Gardei, John F. Myers, and such other persons as shall hereafter become members of the corporation hereby created and constituted, and their successors, are hereby created and constituted a body corporate under the name and style of the volunteer firemen's benevolent association of North Tona- wanda, for the purpose of furnishing relief to disabled members of said corporation and their families and providing for the defrayal of funeral expenses of persons hereafter dying while members of said corporation by payment, as its by-laws shall prescribe, to the widow, personal repre- sentative or next-of-kin of each such deceased member, as and for a funeral benefit, of such an amount[, not exceeding one hundred dollars,] as said by-laws shall prescribe; and said corporation shall have perpet- ual succession.
S 2. Notwithstanding any other provision of law, all proceedings and actions taken by the volunteer firemen's benevolent association of North Tonawanda, in relation to the payment of funeral benefits to the widow, widower, personal representative, or next-of-kin of any person who died while being a member of such benevolent association, are hereby legal- ized, validated, ratified and confirmed. Such benevolent association shall hereafter comply with the provisions of section 1 of chapter 38 of the laws of 1903, as amended. S 3. This act shall take effect immediately.
