BILL NUMBER:S5091 TITLE OF BILL: An act to amend the social services law, in relation to creating the child care regulatory review task force PURPOSE: To relieve unnecessary burdens on child day care providers so that they are better able to maintain a stable, quality program. SUMMARY OF PROVISIONS: Section 1 amends the social services law by adding a new section 390-j creating the Child Care Regulatory Review Task Force to review statutory and regulatory requirements for child day care providers. The new section delineates the members of the Task Force: the Commissioner of the Office for Children and Family Services, the Commissioner of the Office of Temporary and Disability Assistance, the Commissioner of the Department of Health, the Commissioner of the Administration for Children's Services and the Commissioner of the Department of Health and Mental Hygiene, or their designees. This section also specifies the duties of the Task Force, including holding one public hearing, reviewing regulatory and statutory requirements and issuing a report with recommendations to the Legislature three years from the effective date.

RITCHIE -- read twice and ordered printed, and when printed to be committed to the Committee on Children and Families AN ACT to amend the social services law, in relation to creating the child care regulatory review task force THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The social services law is amended by adding a new section 390-j to read as follows: S 390-J. THE CHILD CARE REGULATORY REVIEW TASK FORCE. 1. DUTIES. (A) PURSUANT TO THE PROVISIONS OF THIS SECTION, THE CHILD CARE REGULATORY REVIEW TASK FORCE SHALL REVIEW PROCESSES AND REGULATORY, STATUTORY AND PROGRAMMATIC REQUIREMENTS, PLACED ON CHILD CARE PROVIDERS WHICH ARE REGULATED BY THE OFFICE OF CHILDREN AND FAMILY SERVICES, THAT ARE DUPLI- CATIVE OR UNNECESSARY AND CREATE ADMINISTRATIVE BURDENS FOR CHILD CARE PROVIDERS; (B) HOLD, AT MINIMUM, ONE PUBLIC HEARING TO OBTAIN ORAL AND/OR WRITTEN TESTIMONY FROM INTERESTED STAKEHOLDERS; (C) DEVELOP AND PROPOSE RECOMMENDATIONS FOR THE STREAMLINING OF CURRENT PROCESSES AND REQUIREMENTS WHICH ARE IDENTIFIED AS DUPLICATIVE OR BURDENSOME; (D) SUCH RECOMMENDATIONS SHALL BE SUBMITTED TO THE LEGISLATURE ANNUAL- LY. 2. MEMBERSHIP. (A) THE TASK FORCE SHALL CONSIST OF, AT A MINIMUM, THE COMMISSIONER OF THE OFFICE OF CHILDREN AND FAMILY SERVICES; THE COMMIS- SIONER OF THE OFFICE OF TEMPORARY AND DISABILITY ASSISTANCE; THE COMMIS- SIONER OF THE DEPARTMENT OF HEALTH AND THE COMMISSIONER OF THE NEW YORK CITY DEPARTMENT OF HEALTH AND MENTAL HYGIENE. (B) THE MEMBERS OF THE CHILD CARE REGULATORY TASK FORCE SHALL NOT RECEIVE ANY COMPENSATION. HOWEVER, THE MEMBERS SHALL BE ENTITLED TO REIMBURSEMENT FOR ANY NECESSARY EXPENSES INCURRED IN CONNECTION WITH THE PERFORMANCE OF THEIR DUTIES.
