BILL NUMBER:S5104 TITLE OF BILL: An act to amend the general business law, in relation to requiring food vendors to provide a trash receptacle PURPOSE OR GENERAL IDEA OF BILL: The purpose of the bill is to require food vendors to provide a trash receptacle for patrons, as well as post signs instructing patrons to keep the area clean. SUMMARY OF PROVISIONS: Section 1 of the bill amends section 391 of the general business law by adding a new section 391-t Subsection 1 provides that food vendors shall be required to provide a trash receptacle within the immediate vicinity of their vehicle or push cart. Vendors shall also post signs to the vehicle or cart in a conspicuous place, instructing patrons to dispose of trash in the receptacle and to keep the area clean. Subsection 2 defines "food vendor" as any person who hawks, peddles, sells or offers food for sale at retail in a public space. Section 2 provides that this act shall take effect immediately JUSTIFICATION:

The general business law is amended by adding a new section 391-t to read as follows: S 391-T. FOOD VENDORS; REQUIRED TRASH RECEPTACLE. 1. EVERY FOOD VENDOR SHALL PROVIDE A TRASH RECEPTACLE WITHIN THE IMMEDIATE VICINITY OF HIS OR HER VENDING VEHICLE OR PUSH CART. SIGNS INSTRUCTING PATRONS TO DISPOSE OF TRASH IN THE RECEPTACLE AND KEEP THE AREA CLEAN SHALL BE POSTED TO THE VENDING VEHICLE OR PUSH CART IN A CONSPICUOUS PLACE. 2. FOR PURPOSES OF THIS SECTION, A FOOD VENDOR IS ANY PERSON WHO HAWKS, PEDDLES, SELLS, OR OFFERS FOOD FOR SALE AT RETAIL IN ANY PUBLIC SPACE. S 2. This act shall take effect immediately.
