BILL NUMBER:S5106 TITLE OF BILL: An act to amend the environmental conservation law, in relation to hunting in the counties of Chemung, Steuben, and Yates PURPOSE: To permanently allow sportsmen in the counties of Chemung, Steuben and Yates to hunt deer and bear with a rifle. SUMMARY OF PROVISIONS: The bill amends Environmental Conservation Law section 11-0907 to add Chemung, Steuben and Yates Counties to the list of counties in which the taking of deer or bear by rifle is authorized. EXISTING LAW: Environmental Conservation Law Section 11-0907 currently allows the taking of deer or bear in the southern tier region by rifle in Alleghany, Cattaraugus, Chemung, Chenango, Herkimer, Montgomery, Oneida, Oswego, Otsego, Schoharie, Steuben, Tioga, Yates, and a portion of Broome County. JUSTIFICATION: Chapter 600 of the laws of 2005 authorized the taking of deer in various counties in the southern tier and eastern region of the state. This decision was based upon the increasing deer population and declining hunting population which resulted in increased crop damage and collision with automobiles. Chapter 296 of the laws of 2007 authorized the taking of deer by rifle in Chemung, Steuben and Yates Counties. Successful implementation of the rifle deer hunting change and continuing deer overpopulation problems in Chemung, Steuben and Yates Counties now support the extension of rifle hunting into this neighboring southern tier municipality. LEGISLATIVE HISTORY: New Bill. FISCAL IMPLICATIONS: None. LOCAL FISCAL IMPLICATIONS: None. EFFECTIVE DATE: Immediately, with provisions.

AN ACT to amend the environmental conservation law, in relation to hunt ing in the counties of Chemung, Steuben, and Yates THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. Item (i) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law, as amended by section 12 of chap ter 483 of the laws of 2010, is amended to read as follows:
(i) The counties of Deer and bear, the Pistol, shotgun, Allegany, first Monday after crossbow, Cattaraugus, CHEMUNG, November 15 through muzzle loading Chenango, Herkimer, first Tuesday after firearm, rifle or Montgomery, Oneida, December 7 long bow only Oswego, Otsego, Schoharie [and], STEUBEN, Tioga, AND YATES and that portion of the county of Broome east of the Susquehanna river

S 3. This act shall take effect immediately; provided, however, that section one of this act shall take effect on the same date as section 12 of chapter 483 of the laws of 2010 takes effect and shall be subject to the repeal of such section 12 pursuant to section 17 of chapter 483 of the laws of 2010; and provided further that section two of this act shall take effect on the same date as the reversion of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law, as provided in section 13 of chapter 600 of the laws of 1993, as amended, or section 17 of chapter 483 of the laws of 2010, as amended, whichever is later.
