BILL NUMBER:S5110 TITLE OF BILL: An act to amend the public service law, in relation to electric car charging stations PURPOSE: To ensure that electric car charging stations are not subject to regulation as an electric corporation by the Public Service Commission SUMMARY OF PROVISIONS: Section 1: Amends section 5 of the public service law to clarify that a person or corporation who owns, leases or operates an electric car charging station is not subject to the regulations of this section, that are typically applied to electric utility corporations. Section 2: Sets forth the effective date JUSTIFICATION: Recently the Legislature approved the Charge NY program as a part of the 2013-2014 budgets. This program will lead to the installation of 360 electric vehicle and plug-in hybrid charging stations across New York State. The State's goal is to create a statewide network of up to 3,000 stations over the next several years in order to put 40,000

MAZIARZ -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommuni- cations AN ACT to amend the public service law, in relation to electric car charging stations THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 5 of the public service law is amended by adding a new subdivision 7 to read as follows: 7. A PERSON OR CORPORATION OWNING, LEASING OR OPERATING A FACILITY THAT SUPPLIES ELECTRICITY TO THE PUBLIC FOR THE SOLE PURPOSE OF CHARGING PLUG-IN ELECTRIC VEHICLES IS NOT SUBJECT TO THE PROVISIONS OF THIS CHAP- TER AS AN ELECTRIC CORPORATION SOLELY BECAUSE OF SUCH OWNERSHIP, LEASE OR OPERATION.
