BILL NUMBER:S5152 TITLE OF BILL: An act to authorize Steven M. Carlson to apply for retroactive membership in the New York state and local employees' retirement system on the basis of prior seasonal employment by the department of parks and recreation of the city of New York PURPOSE: To allow Steven Carlson to apply for membership in the New York City employees' retirement system and retroactive membership in the New York state and local employees' retirement system. This bill would allow Mr. Carlson to be eligible to apply for retroactive membership upon completion of a timely and acceptable application to the state comptroller. SUMMARY OF PROVISIONS: Section 1 authorizes Steven M. Carlson to apply for and receive membership in the New York City employees' retirement system and retroactive membership in the New York state and local employees' retirement system, beginning June 19, 1968, pursuant to section 645 of retirement and social security law, provided that he submit a written application to the state comptroller within one year of the effective

SEWARD -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions AN ACT to authorize Steven M. Carlson to apply for retroactive member- ship in the New York state and local employees' retirement system on the basis of prior seasonal employment by the department of parks and recreation of the city of New York THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law to the contrary, Steven M. Carlson, a member of the New York state and local employees' retirement system employed by the department of health, who was previ- ously employed as a seasonal recreation assistant by the department of parks and recreation of the city of New York commencing on June 19, 1968, who for reasons not ascribable to his own negligence failed to become a member of the New York city employees' retirement system during such seasonal employment, and who previously transferred prior service credit and his membership in the New York city employees' retirement system to the New York state and local employees' retirement system pursuant to section 645 of the retirement and social security law on the basis of other subsequent employment by the city of New York, shall be authorized to apply for, pursuant to section 645 of the retirement and social security law, and receive membership in the New York city employ- ees' retirement system and a retroactive membership in the New York state and local employees' retirement system commencing on June 19, 1968, if within one year of the effective date of this act he shall submit a written application therefor with the state comptroller.
