TITLE OF BILL:
An act
to amend the agriculture and markets law, in relation to expanding the
definition of crops, livestock and livestock products to include
silvopasturing products

PURPOSE:
To clarify that silvopasturing acreage in forested land qualifies as
eligible lands for agriculture assessment.

SUMMARY:
Section 301(2) of Agriculture and Markets Law is amended to include
silvopastured products to the definition of "Crops, livestock and
livestock products",

JUSTIFICATION:
Silvopasturing is the scientifically-based, ecologically-sound practice
of livestock grazing in wooded areas which can yield numerous benefits
for farm operations. In silvopasturing, timber and pasture are managed
as a single integrated system. Timber, forage and livestock are managed
intensively to simultaneously produce timber products, a high quality
forage resource and efficient livestock production. In doing so,
silvopasturing provides a sustainable system that offers diversified
marketing opportunities for producers.

This bill would clearly recognize the concurrent use of wooded lands for
production of livestock and wood products as land in agricultural
production that qualifies for the agricultural assessment program.
Current law does not allow assessors to grant agricultural assessments
to forested land used for silvopasture based on the characterization
that such land is employed to produce livestock or livestock products
for sale.

AN ACT to amend the agriculture and markets law, in relation to  expand
 ing  the  definition  of  crops,  livestock  and livestock products to
 include silvopasturing products
 THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM
 BLY, DO ENACT AS FOLLOWS:

 

Section 1. Subdivision 2 of section 301 of the agriculture and markets
 law is amended by adding a new paragraph k to read as follows:

 K.  SILVOPASTURED  PRODUCTS,  INCLUDING  PRODUCTS  FROM  A PLANNED AND
 MANAGED COMBINATION OF TREES, FORAGES AND  COMMERCIAL  LIVESTOCK  FOR  A
 PRODUCTIVE BENEFIT.
 

S 2. This act shall take effect immediately.
