BILL NUMBER:S5160A TITLE OF BILL: An act to amend the agriculture and markets law, in relation to the definition of land used in silvopasturing PURPOSE: To clarify that certain silvopasturing acreage in forested land qualifies as eligible lands for agricultural assessment. SUMMARY OF PROVISIONS: Section 301(2) of the Agriculture and Markets Law is amended to add certain silvopastured products to the definition of "Crops, livestock and livestock products". JUSTIFICATION: Silvopasturing is the scientifically-based, ecologically-sound practice of livestock grazing in wooded areas which can yield numerous benefits for farm operations. In silvopasturing, timber and pasture are managed as a single integrated system. Timber, forage and livestock are managed intensively to simultaneously produce timber products, a high quality forage resource and efficient livestock production. In doing so, silvopasturing provides a sustainable system that offers diversified marketing opportunities for producers. Current law does not allow assessors to grant agricultural assessments to forested land used for silvopasture, based on the characterization that such land is employed to produce livestock or livestock products for sale. This bill would clearly recognize the concurrent use of wooded lands for production of livestock and wood products as land used in agricultural production that qualifies for the agricultural assessment program. Silvopaturing land would be limited to ten fenced acres for large livestock and five fenced acres for smaller livestock, in order to be considered for an agricultural assessment. LEGISLATIVE HISTORY: New Bill. FISCAL IMPLICATIONS: To be determine. EFFECTIVE DATE: This act shall take effect on the first of January next succeeding the date on which it shall become a law.

Section 1.
Section 301 of the agriculture and markets law is amended by adding a new subdivision 18 to read as follows:
18. "LAND USED IN SILVOPASTURING" MEANS THE INTENTIONAL COMBINATION OF TREES, FORAGES AND LIVESTOCK MANAGED AS A SINGLE INTEGRATED PRACTICE FOR THE COLLECTIVE BENEFIT OF EACH, INCLUDING THE PLANTING OF APPROPRIATE GRASSES AND LEGUME FORAGES AMONG TREES FOR SOUND GRAZING AND LIVESTOCK HUSBANDRY. LAND USED IN SILVOPASTURING SHALL BE LIMITED TO UP TO TEN FENCED ACRES PER LARGE LIVESTOCK, INCLUDING CATTLE, HORSES AND CAMELIDS, AND UP TO FIVE FENCED ACRES PER SMALL LIVESTOCK, SUCH AS SHEEP, HOGS, GOATS AND POULTRY.
S 2. The commissioner of taxation and finance, in consultation with the commissioner of agriculture and markets and the commissioner of environmental conservation, shall promulgate any regulations necessary and proper for the implementation of this act.
