BILL NUMBER:S5244 TITLE OF BILL: An act to direct the commissioner of transportation to examine, evaluate and report upon the unsafe use of bicycles on public highways PURPOSE: To determine the safety or lack thereof while riding a bicycle on public highways. SUMMARY OF PROVISIONS: Section 1, the commissioner shall examine, evaluate and make recommendations on the use of bicycles upon public highways. This will include the following; violations of the rules of the road, vehicular accidents involving bicycles, number of vehicular accidents caused by bicycle riders, pedestrian accidents involving bicycles, pedestrian accidents caused by bicycle riders, property damage accidents involving bicycles, number of property damage accidents involving bicycle riders, the number of individuals suffering personal injury or death as a result of vehicular accidents, pedestrian accidents, and property damage accidents involving bicycles, bike lane violations by bicycle riders, use of helmets by bicycle riders, and a comparison of the incidence of personal injury and death to bicycle riders involved in accidents who were wearing helmets and those who were not wearing helmets.

FELDER -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to direct the commissioner of transportation to examine, evaluate and report upon the unsafe use of bicycles on public highways THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The commissioner of transportation shall examine, evaluate and make recommendations on the unsafe use of bicycles upon public high- ways. Such commissioner shall direct his or her attention to at least the following: (a) the incidence of violations of the rules of the road, as specified in the vehicle and traffic law, and local laws, ordinance and codes, by bicycle riders, on a statewide basis and by county; (b) the incidence of vehicular accidents involving bicycles, on a statewide basis and by county; (c) the number of vehicular accidents caused by bicycle riders, on a statewide basis and by county; (d) the incidence of pedestrian accidents involving bicycles, on a statewide basis and by county; (e) the number of pedestrian accidents caused by bicycle riders, on a statewide basis and by county; (f) the incidence of property damage accidents involving bicycles, on a statewide basis and by county; (g) the number of property damage accidents caused by bicycle riders, on a statewide basis and by county; (h) the number of individuals suffering personal injury or death as the result of vehicular accidents, pedestrian accidents and property damage accidents involving bicycles, on a statewide basis and by county; (i) the incidence of bike lane violations by bicycle riders; (j) the use of helmets by bicycle riders, on a statewide basis and by county; and EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
