TITLE OF BILL : An act to amend the criminal procedure law, in relation to granting peace officer status to animal control officers employed by the county of Schuyler

PURPOSE : This bill would grant animal control officers employed by Schuyler County peace officer status.

SUMMARY OF PROVISIONS : Section 1 of the bill amends section 2.10 of the criminal procedure law by adding a new subdivision 83 authorizing animal control officers employed by Schuyler County to be given peace officer status.

Section 2 of the bill provides that the bill shall take effect immediately.

JUSTIFICATION : This legislation comes at the request of the Office of the Sheriff of Schuyler County. The Animal Control Officer in Schuyler County is an essential position investigating animal cruelty complaints as well as issuing summonses for violations of state and local laws. When the current Animal Control Officer was hired in Schuyler County it was assumed that this individual was a Peace Officer under the Criminal Procedure Law. This legislation remedies said oversight by granting Animal Control Officers in Schuyler County Peace Officer status.

O'MARA -- read once and referred to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to granting peace officer status to animal control officers employed by the county of Schuyler THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2.10 of the criminal procedure law is amended by adding a new subdivision 83 to read as follows: 83. ANIMAL CONTROL OFFICERS EMPLOYED BY THE COUNTY OF SCHUYLER; PROVIDED, HOWEVER, THAT NOTHING IN THIS SUBDIVISION SHALL BE DEEMED TO AUTHORIZE SUCH INDIVIDUALS TO CARRY, POSSESS, REPAIR OR DISPOSE OF A FIREARM UNLESS THE APPROPRIATE LICENSE THEREFOR HAS BEEN ISSUED PURSUANT TO SECTION 400.00 OF THE PENAL LAW. S 2. This act shall take effect immediately.
