TITLE OF BILL : An act to amend the vehicle and traffic law and the state finance law, in relation to creating the veteran's outreach center distinctive license plate program and applying the revenues raised from such new program to the purposes of supporting the veteran's outreach center fund

PURPOSE : By permitting the issuance of license plates with the phrase

"Serving Those Who Serve U.S.," this legislation would not only raise awareness for those who served our country, but also increase funding for needed Veteran's Outreach Centers.

SUMMARY OF SPECIFIC PROVISIONS : Section 1: The vehicle and traffic law is amended by adding a new section 404-x to read as follows: Distinctive veteran's outreach center license plates. 1. Any person residing in this state shall, upon request, be issued a distinctive veteran's outreach center license plate in support of the Veteran's Outreach Center, Inc. in Rochester, New York bearing the phrase "Serving Those Who Serve U.S." Application for said license plate shall be filed with the commissioner in such form and detail as the commissioner shall prescribe. The commissioner shall provide conspicuous notice to applicants, in such form and manner acceptable to the commissioner, that surcharges from the issuance of such distinctive license plate shall, when available, be used for comprehensive veterans' outreach services provided by the Veteran's Outreach Center, Inc. in Rochester, New York. 2. A distinctive plate issued pursuant to this section shall be issued in the same manner as other number plates upon the payment of the regular registration fee prescribed by section four hundred one of this article; provided, however, that an additional annual service charge of twenty-five dollars shall be charged for such plates. Such annual service charge shall be deposited pursuant to the provisions of section four hundred four-oo of this article to the credit of the department of motor vehicles distinctive plate development fund and shall be used for the production, design, advertising and marketing of distinctive license plates pursuant to such section ninety-five-g; provided, however, that annual service charges collected in excess of six thousand dollars shall be deposited to the credit of the "veteran's outreach center fund" established pursuant to section ninety-nine-t of the state finance law and shall be used for grants to the Veteran's Outreach Center, Inc. in Rochester, New York for the provision of comprehensive veterans' outreach services pursuant to such section ninety-nine-t of the state finance law. Section 2: Amends the state finance law by adding a new section 99-t to read: Veteran's outreach center fund. 1. There is hereby established in the joint custody of the commissioner of taxation and finance and the comptroller, a special fund to be known as the veteran's outreach center fund. 2. Such fund shall consist of all revenues received pursuant to the provisions of section four hundred four-w of the vehicle and traffic law, all revenues received pursuant to an appropriation by the legislature and all other moneys appropriated, credited, or transferred thereto from any other fund or source pursuant to law. Nothing contained herein shall prevent the state from receiving grants, gifts, or bequests for the purposes of the fund as defined in this section and depositing them into the fund according to law. 3. Monies of the fund shall be expended only for veteran's outreach services and projects. As used in this section, "veteran's outreach services" means comprehensive outreach programs for veterans and their families provided by a 501 (c)(3) not-for-profit charitable corporation, with a voluntary board, which seeks to assess veterans' needs, manage their care and help them solve their problems. The text of the bill also provides a listing of some of the programs which the Veteran's outreach services include, but does not limit the services to those listed. Section 3: Sets the effective date.

JUSTIFICA TION: This legislation would provide another avenue to raise revenue to help fund the valuable services that Veteran's Outreach Organizations provide. Veteran's Outreach Organizations provide career building, benefit assistance, counseling advocacy and education among other services. They are an important resource for our veterans. Thus, this license plate legislation would not only honor our veterans, but help create a new revenue stream for the Veteran's Outreach Center of Rochester, New York.

IN ROCHESTER, NEW YORK FOR THE PROVISION OF COMPREHENSIVE VETERANS' OUTREACH SERVICES PURSUANT TO SECTION NINETY-NINE-T OF THE STATE FINANCE LAW; PROVIDED, FURTHER, THAT ONE YEAR AFTER THE EFFECTIVE DATE OF THIS SECTION, FUNDS IN THE AMOUNT OF SEVEN THOUSAND FIVE HUNDRED DOLLARS, OR SO MUCH THEREOF AS MAY BE AVAILABLE, SHALL BE ALLOCATED FROM SUCH FUND TO THE DEPARTMENT TO OFFSET COSTS ASSOCIATED WITH THE PRODUCTION OF SUCH LICENSE PLATES. S 2. The state finance law is amended by adding a new section 99-t to read as follows: S 99-T. VETERAN'S OUTREACH CENTER FUND. 1. THERE IS HEREBY ESTABLISHED IN THE JOINT CUSTODY OF THE COMMISSIONER OF TAXATION AND FINANCE AND THE COMPTROLLER, A SPECIAL FUND TO BE KNOWN AS THE VETERAN'S OUTREACH CENTER FUND. 2. SUCH FUND SHALL CONSIST OF ALL REVENUES RECEIVED PURSUANT TO THE PROVISIONS OF SECTION FOUR HUNDRED FOUR-X OF THE VEHICLE AND TRAFFIC LAW, ALL REVENUES RECEIVED PURSUANT TO AN APPROPRIATION BY THE LEGISLA- TURE, AND ALL OTHER MONEYS APPROPRIATED, CREDITED, OR TRANSFERRED THERE- TO FROM ANY OTHER FUND OR SOURCE PURSUANT TO LAW. NOTHING CONTAINED HEREIN SHALL PREVENT THE STATE FROM RECEIVING GRANTS, GIFTS, OR BEQUESTS FOR THE PURPOSES OF THE FUND AS DEFINED IN THIS SECTION AND DEPOSITING THEM INTO THE FUND ACCORDING TO LAW. 3. MONIES OF THE FUND SHALL BE EXPENDED ONLY FOR GRANTS TO THE VETER- AN'S OUTREACH CENTER, INC. IN ROCHESTER, NEW YORK, A NOT-FOR-PROFIT CORPORATION EXEMPT FROM TAXATION UNDER SECTION 501(C)(3) OF THE INTERNAL REVENUE CODE ESTABLISHED IN THIS STATE WITH A VOLUNTARY BOARD, FOR THE PURPOSE OF PROVIDING COMPREHENSIVE VETERANS' OUTREACH SERVICES. AS USED IN THIS SECTION, "COMPREHENSIVE VETERANS' OUTREACH SERVICES" SHALL MEAN SERVICES PROVIDED TO, OR PROJECTS FOR THE BENEFIT OF, VETERANS AND THEIR FAMILIES WHO ARE RESIDENTS OF THIS STATE, PERTAINING TO HEALTH, MEDICAL AND REHABILITATION SERVICES, EMPLOYMENT AND RE-EMPLOYMENT SERVICES, AND OTHER SERVICES ADDRESSING THE NEEDS OF VETERANS AND THEIR FAMILIES, EXCLUSIVE OF ADMINISTRATIVE EXPENSES, INCLUDING, BUT NOT LIMITED TO: A. CAREER COUNSELING; B. JOB DEVELOPMENT; C. MENTORING; D. BENEFITS ASSISTANCE; E. SUBSTANCE ABUSE AND MENTAL HEALTH COUNSELING; F. VETERAN ADVOCACY AND COMMUNITY EDUCATION; G. TRANSPORTATION; H. SOCIAL SERVICES; I. EMERGENCY, TRANSITIONAL, AND SUPPORTIVE HOUSING; J. MEDICAL FACILITY REFERRALS; K. CASE MANAGEMENT; AND L. CAPITAL PROJECTS IN SUPPORT OF SUCH PROGRAMS. 4. MONIES SHALL BE PAYABLE FROM THE FUND TO THE VETERAN'S OUTREACH CENTER, INC. IN ROCHESTER, NEW YORK ON THE AUDIT AND WARRANT OF THE COMPTROLLER ON VOUCHERS APPROVED BY THE COMPTROLLER. NO MONEY FROM SUCH FUND MAY BE WITHDRAWN, TRANSFERRED, OR USED BY ANY PERSON OR ENTITY FOR ANY PURPOSE OTHER THAN AS PERMITTED BY THIS SECTION. S 3. This act shall take effect on the one hundred eightieth day after it shall have become a law.
