BILL NUMBER:S5318 TITLE OF BILL: An act to amend chapter 203 of the laws of 1999, amending the environmental conservation law relating to extending Nassau county's authority to initiate and enforce certain actions, in relation to the extension of Nassau county's authority to initiate and enforce certain actions PURPOSE: This bill extends until October 1, 2011, the authority of the Health Commissioner of Nassau County, pursuant to Environmental Conservation Law Section 71-1939, to enforce certain provisions of the Environmental Conservation Law for water pollution control. SUMMARY OF PROVISIONS: Section 1 of the bill amends Section 2 of Chapter 203 of the laws of 1999, by extending through October 1, 2013, the authority granted by Environmental Conservation Law Section 71-1939 (c) and (d) to the Nassau County Health Commissioner to enforce certain provisions of the Environmental Conservation Law relating to water pollution control, including the general prohibition against water pollution and pollution of the marine district, and for the control of bulk storage of petroleum. These provisions previously were extended by chapter 86 of the laws of 2009 through October 1, 2011. JUSTIFICATION: This legislation is needed to preserve the Nassau County Health Commissioner's power to enforce certain provisions of the Environmental Conservation Law regulating water pollution. Nassau County's water bodies are perhaps its most precious natural resource. It is critical to the welfare of the residents of the County that the County's water resources be vigorously protected. Preserving the County Health Commissioner's power to enforce water pollution control regulations is thus essential. LEGISLATIVE HISTORY: New Bill. FISCAL IMPLICATIONS: None to the State. EFFECTIVE DATE: Immediately.

AN ACT to amend chapter 203 of the laws of 1999, amending the environ-
mental conservation law relating to extending Nassau county's authori-
ty to initiate and enforce certain actions, in relation to the exten-
sion of Nassau county's authority to initiate and enforce certain
actions
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 2 of chapter 203 of the laws of 1999, amending the
environmental conservation law relating to extending Nassau county's
authority to initiate and enforce certain actions, as amended by chapter
86 of the laws of 2009, is amended to read as follows:
S 2. This act shall take effect on October 1, 1999, and shall remain
in force and effect until October 1, [2011] 2013, on which date it shall
expire and be deemed repealed.
S 2. This act shall take effect immediately.
