BILL NUMBER:S5326 TITLE OF BILL: An act to amend the highway law, in relation to expand- ing the Western New York Southtowns scenic byway PURPOSE: To expand the Western New York Southtowns scenic byway in the county of Cattaraugus. SUMMARY OF PROVISIONS: Section 1. Amends paragraph j-10 of subdivision 1 of Section 349-dd of the Highway Law to include the "Western New York Southtowns Scenic Byway" expansion as a component of the New York State Scenic Byways System, and designates these portions of the highways as an extension to the "Western New York Southtowns Scenic Byway". Section 2. Provides that this act shall take effect immediately. EXISTING LAW: Section 349-dd, subdivision 1, of the Highway Law enumerates the compo- nents of the New York State Scenic Byways System. JUSTIFICATION:

YOUNG -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the highway law, in relation to expanding the Western New York Southtowns scenic byway THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (j-10) of subdivision 1 of section 349-dd of the highway law, as added by chapter 248 of the laws of 2008, is amended to read as follows: (j-10) The Western New York Southtowns scenic byway which shall consist of all that portion of the highway system beginning at the intersection of state route four hundred and United States route twen- ty-A (Quaker road) in the village of East Aurora, town of Aurora, Erie county, westerly along United States route twenty-A to the Big Tree road and United States route twenty-A interchange with United States route two hundred nineteen in the town of Orchard Park, Erie county, then continuing southerly along United States route two hundred nineteen, through the towns of Boston and Concord AND THE VILLAGE OF SPRINGVILLE, Erie county, [to the Springville and route thirty-nine interchange, then easterly along state route thirty-nine, through the village of Spring- ville] AND THE TOWN OF ASHFORD, CATTARAUGUS COUNTY, TO THE INTERSECTION WITH STATE ROUTE TWO HUNDRED FORTY-TWO IN THE TOWN OF ELLICOTTVILLE, CATTARAUGUS COUNTY, THEN CONTINUING WESTERLY ALONG UNITED STATES ROUTE TWO HUNDRED NINETEEN AND STATE ROUTE TWO HUNDRED FORTY-TWO TO THE VILLAGE OF ELLICOTTVILLE, THEN CONTINUING SOUTHERLY ON UNITED STATES ROUTE TWO HUNDRED NINETEEN TO THE TOWN OF ELLICOTTVILLE TOWN LINE, WHICH SHALL BE THE TERMINUS OF THIS PORTION OF THE BYWAY; SUCH BYWAY SHALL ALSO INCLUDE ALL THAT PORTION OF THE HIGHWAY SYSTEM BEGINNING AT THE INTERSECTION OF UNITED STATES ROUTE TWO HUNDRED NINETEEN AND STATE ROUTE TWO HUNDRED FORTY-TWO IN THE TOWN OF ELLICOTTVILLE, CATTARAUGUS COUNTY, NORTHEASTERLY ALONG STATE ROUTE TWO HUNDRED FORTY-TWO to the inter- EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
