BILL NUMBER:S5334 REVISED 6/4/15 TITLE OF BILL: An act to amend chapter 486 of the laws of 1964, establishing and constituting as a separate union free school district certain territory in the town of Canaan in the county of Columbia, and providing for its government, in relation to making technical amendments thereto PURPOSE OR GENERAL IDEA OF BILL: To establish and allow the Berkshire Union Free School District, located in the town of Canaan, to operate educational programs at the Berkshire Union Free School District's leased facility located at 11 Warren Street, Hudson, New York 12534. SUMMARY OF SPECIFIC PROVISIONS: Amends chapter 486 of the laws of 1964, as amended by chapter 337 of the Laws of 2013, to authorize such school district to provide educational programs at 11 Warren Street, Hudson, New York 12534. JUSTIFICATION: In 1964, by Special Act of the New York State Legislature, Berkshire Union Free School District was organized to provide public education services to the youth in residence at Berkshire Farm Center in the town of Canaan, county of Columbia In 2013, the District was authorized to provide educational services at a leased facility located at 364 Warren Street in Hudson, New York. The District now has the need and opportunity to move the program to a larger leased facility on the same street This bill amends the

MARCHIONE -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend chapter 486 of the laws of 1964, establishing and constituting as a separate union free school district certain territo- ry in the town of Canaan in the county of Columbia, and providing for its government, in relation to making technical amendments thereto THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2-a of chapter 486 of the laws of 1964, establish- ing and constituting as a separate union free school district certain territory in the town of Canaan in the county of Columbia, and providing for its government, as added by chapter 337 of the laws of 2013, is amended to read as follows: S 2-a. Notwithstanding any other law, rule, or regulation to the contrary, in addition to the powers granted by section one of this act, subject to the approval of the New York state education department and the board of cooperative educational services for the sole supervisory district of Rensselaer, Columbia, and Greene counties, the board of education shall be authorized to utilize property located at [364] 11 Warren Street, Hudson, New York 12534, and to enter into any agreements necessary to carry out such authority, for the purpose of providing instruction to students enrolled in the Berkshire Union Free School District.
