TITLE OF BILL: An act to amend chapter 779 of the laws of 1986, amending the social services law relating to authorizing services for non-residents in adult homes, residences for adults and enriched housing programs, in relation to extending the provisions thereof for three years

PURPOSE: The purpose of this bill is to continue the program which authorizes the provision of services for nonresidents in adult homes, residences for adults and enriched housing programs.

SUMMARY OF PROVISIONS: The bill would extend the program which authorizes the provision of services to non-residents of adult homes, residences for adults and enriched housing programs from July 1, 2011 to July 1, 2014.

JUSTIFICATION: Adult homes, residences for adults, and enriched housing programs are increasingly viewed as potential community-based service providers for those adults, who are in need of temporary or short-term support but not residential care. The two most significant non-resident services available are adult day care and temporary residential placement (respite). These programs provide a variety of support services to assist family caregivers in their efforts to maintain their frail and disabled relatives in the community and prevent and/or delay institutionalization. The provision of services to non-residents of adult homes, residences for adults, and enriched housing programs is one avenue for relief for informal caregivers. Both services are widely recognized as relieving the stress associated with the burden of caring for an elderly or impaired relative.

HANNON -- read twice and ordered printed, and when printed to be committed to the Committee on Social Services AN ACT to amend chapter 779 of the laws of 1986, amending the social services law relating to authorizing services for non-residents in adult homes, residences for adults and enriched housing programs, in relation to extending the provisions thereof for three years THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 4 of chapter 779 of the laws of 1986, amending the social services law relating to authorizing services for non-residents in adult homes, residences for adults and enriched housing programs, as amended by chapter 83 of the laws of 2008, is amended to read as follows: S 4. This act shall take effect on the one hundred twentieth day after it shall have become a law and shall remain in full force and effect until July 1, [2011] 2014, provided however, that effective immediately, the addition, amendment and/or repeal of any rules or regulations neces- sary for the implementation of the foregoing sections of this act on its effective date are authorized and directed to be made and completed on or before such effective date. S 2. This act shall take effect immediately.
