BILL NUMBER:S534 TITLE OF BILL: An act to amend the public authorities law, in relation to review of taxpayer-funded contracts with public authorities in a city with a population of over one million PURPOSE: Allows public authority in a city with a population of over 1 million to cancel taxpayer-funded contract where contractor convicted of related crime. SUMMARY OF PROVISIONS: The legislation amends article 9 of the Public Authorities law by adding a new Title 13, �2990 providing grounds for cancellation of contract by public authorities in a city with a population of over 1 million. EXISTING LAW: Under current law, there is very little external oversight of contracts by public authorities. JUSTIFICATION: Public authorities play an important role in managing, maintaining and improving New York's infrastructure, but they spend taxpayers' dollars with little oversight or transparency. Giving the NYC Comptroller's Office oversight over contracts entered into by public authorities serving New York City is the first step towards ensuring that public authorities are held accountable for their use of taxpayer funds. THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. Article 9 of the public authorities law is amended by adding a new title 13 to read as follows:
TITLE 13 TAXPAYER-FUNDED CONTRACTS WITH PUBLIC AUTHORITIES IN A CITY WITH A POPULATION OF OVER ONE MILLION SECTION 2990. GROUNDS FOR CANCELLATION OF CONTRACT BY PUBLIC AUTHORI TIES.
S 2990. GROUNDS FOR CANCELLATION OF CONTRACT BY PUBLIC AUTHORITIES. ANY TAXPAYER-FUNDED CONTRACT FOR THE PROCUREMENT OF GOODS, SERVICES OR CONSTRUCTION WITH AN AUTHORITY OR COMMISSION CONTINUED OR CREATED BY THIS CHAPTER, WHOSE JURISDICTION IS LIMITED TO A CITY WITH A POPULATION OF OVER ONE MILLION SHALL BE REVIEWED BY THE COMPTROLLER OF SUCH CITY. IF THE COMPTROLLER FINDS THAT THE CONTRACTOR WHO HAS BEEN AWARDED THE CONTRACT HAS BEEN CONVICTED OF A CRIME WITHIN FIVE YEARS OF THE AWARDING OF THE CONTRACT, DIRECTLY RELATED TO CONTRACT PROCUREMENT OR PERFORM ANCE, INCLUDING BUT NOT LIMITED TO BID RIGGING, FRAUDULENT BILLING OR ACCOUNTING, PREVAILING WAGE VIOLATIONS AND OSHA VIOLATIONS, THE AUTHORI TY OR COMMISSION MAY CANCEL OR TERMINATE SUCH CONTRACT WITHOUT INCURRING ANY PENALTY OR DAMAGES ON ACCOUNT OF SUCH CANCELLATION OR TERMINATION.
