AN ACT to amend chapter 85 of the laws of 1934, creating the  Chautauqua
  utility district, in relation to the qualifications of the commission-
  ers thereof

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 6 of chapter 85 of the laws of 1934,  creating  the
Chautauqua utility district, is amended to read as follows:
  S  6.  Qualification  of  commissioners.  No  person  shall be elected
commissioner unless [he be a resident of the district, a qualified voter
of] HIS OR HER PRIMARY RESIDENCE IS IN the town of Chautauqua, and HE OR
SHE BE an owner or lessee of taxable real property within the  district,
whose  name  appears  on the last preceding completed assessment roll of
the town of Chautauqua. [A qualified voter,  for  the  purposes  hereof,
shall  be  deemed  to  be  a  person entitled to vote at the immediately
preceding election for supervisor, within the  town  of  Chautauqua;  or
entitled to vote in the immediately preceding state election, within the
town of Chautauqua, as the case may be.]
  S 2. This act shall take effect immediately.
