TITLE OF BILL: An act to legalize, validate, ratify and confirm certain transportation contracts of the New Hyde Park-Garden City Park union free school district

PURPOSE OR GENERAL IDEA OF BILL: This bill would legalize certain transportation contracts from the 2008-2009 school year between the New Hyde Park-Garden City Park Union Free School District and Huntington Coach.

SUMMARY OF SPECIFIC PROVISIONS: Section one of the bill legalizes, validates, ratifies and confirms all acts done by the New Hyde Park-Garden City Park union free school district and by all officers, employees or agents of such school district relating to or in connection with a transportation contract for the 2008-2009 school year, in the amount of $47,160 with Huntington Coach.

Section two of the bill directs the education department to consider the costs of the aforementioned contract set forth in section one of this act as valid.

JUSTIFICATION: There was a situation in the New Hyde Park-Garden City Park Union Free School District during the 2008-2009 school year which proved to be problematic. The district began the school year short two bus drivers, which for most districts might not affect the transportation department drastically, however this district only has 3 in-house drivers when fully staffed. The district was supposed to start the year fully staffed but the finger-printing clearance from the state was taking longer than anticipated. The district's Director of Transportation, after getting, a multiple quotes, hired Huntington Coach and went forward with an emergency contract (allowable by the state for 30 days).

Due to the state's continued delays in the finger-printing process, the contract with Huntington Coach had to be continued for most of the year. The continuation of this contract, for reasons out of the district's control, cost the district and local tax payers $47,160. This legislation would forgive the district of this unanticipated and unfair cost placed on them by the state's slow turnaround time.

MARTINS -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to legalize, validate, ratify and confirm certain transportation contracts of the New Hyde Park-Garden City Park union free school district THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. All acts done and proceedings heretofore had and taken or caused to be had and taken by the New Hyde Park-Garden City Park union free school district and by all officers, employees or agents of such school district relating to or in connection with a transportation contract for the 2008-2009 school year, in the amount of $47,160, with Huntington Coach, and all acts incidental thereto are hereby legalized, validated, ratified and confirmed, notwithstanding any failure of such school district to comply with the contract award, approvals and filing provisions of the education law, general municipal law or any other law or any other statutory authority, rule or regulation, other than those filing provisions defined in paragraph a of subdivision 5 of section 3604 of the education law, in relation to any omission, error, defect, irregularity or illegality in such proceeding had and taken, and provided further that any amount due and payable to the New Hyde Park- Garden City Park union free school district as a result of this act shall be paid pursuant to the provisions of paragraph c of subdivision 5 of section 3604 of the education law. S 2. The education department is hereby directed to consider the costs of the aforementioned contract set forth in section one of this act for transportation aid as valid and proper obligations of the New Hyde Park- Garden City Park union free school district. S 3. This act shall take effect immediately.
