TITLE OF BILL: An act to amend the executive law, in relation to adding the Wappinger Creek to the definition of inland waterways
This legislation will include the Wappinger Creek as one of New York State's major creeks, and for it to be considered an inland waterway.
SUMMARY OF PROVISIONS:
Section 1 amends paragraph (c) of subdivision 4 of section 911 of the executive law to include Wappinger Creek among the state's major creeks.
Section 2 establishes an effective date.
Wappinger Creek plays an important role in Dutchess County, as it is the basis for the county's largest watershed. It is home to a number of resident and migratory species, and is a vital component of the Dutchess county ecosystem.
A healthy creek is important for groundwater quality, biodiversity, and recreation. However, upstream development and pollutants introduced in the upper creek have led to contamination of the public water supply wells in the lower watershed, which now includes six water bodies that are listed on DEC's Priority Waterbody List because they no longer meet their intended uses due to pollution. Efforts must be undertaken to remediate and restore the creek. Designation as an inland waterbody opens opportunities for funds for pollution clean-up and waterfront revitalization.
