BILL NUMBER: S541 TITLE OF BILL : An act to amend the alcoholic beverage control law, in relation to terms of sale of alcoholic beverages PURPOSE : This bill will provide manufacturers and wholesalers greater flexibility in developing payment plans with retailers. SUMMARY OF PROVISIONS : Section 1. Amends paragraph a of subdivision 1 of section 101-aa of the alcoholic beverage control law to define credit period as a period beginning on the date alcoholic beverages are delivered and ending sixty days thereafter. EXISTING LAW : Currently, credit period is defined as a period beginning on the date alcoholic beverages are delivered and ending thirty days thereafter. JUSTIFICATION : The current thirty-day credit period that manufacturers and wholesalers are required to limit retailers to is onerously short. A

GALLIVAN -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the alcoholic beverage control law, in relation to terms of sale of alcoholic beverages THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph a of subdivision 1 of section 101-aa of the alco- holic beverage control law, as amended by chapter 84 of the laws of 2004, is amended to read as follows: a. "Credit period" means a period beginning on the date alcoholic beverages are delivered and ending [thirty] SIXTY days thereafter. S 2. This act shall take effect immediately.
