S5474-2011 Memo
BILL NUMBER:S5474 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to fees for searches and copies of documents of the department of motor vehicles PURPOSE: Amends Section 202 of the vehicle and traffic law to exempt legal aid societies and bureaus and other entities that provide representation pursuant to County Law 722(2) from the fees charged by the Department of Motor Vehicles for record searches and copies of documents. SUMMARY OF PROVISIONS: Section 1 amends subdivision 1 of vehicle and traffic law section 202 to add legal aid bureaus and societies and other organizations that provide public defense representation to the list of entities that are exempt from fees for department of motor vehicles record searches and copies of documents. JUSTIFICATION: Under Vehicle and Traffic Law 202(1), public defender offices are able to access DMV records without a fee. Counties that provide public defense representation through a legal aid bureau or society or other organization authorized under County Law 722(2), however, must bear the cost of that organization's DMV record searches. Because the legal aid organizations are providing the same services as public defender offices and counties pay the cost of those services, legal aid organizations should be added to the list of exempt entities in Vehicle and Traffic Law 202(1). LEGISLATIVE HISTORY: New bill. FISCAL IMPLICATIONS: Minimal for the State. Local governments will realize a cost savings. EFFECTIVE DATE: Immediately.
