AN ACT to direct the commissioner of health and  the  superintendent  of
  financial  services  to  study and report upon the impact of requiring
  that certain health insurance plans provide coverage for treatment  of
  mitochondrial disease

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The commissioner of health and the superintendent of finan-
cial services shall cause a study to  be  performed  on  the  impact  of
requiring  that  certain  health  insurance  plans  provide coverage for
treatment of mitochondrial disease. Such study shall include an  assess-
ment  of  the impact of such a requirement on costs to insurance provid-
ers, the cost of insurance premiums, and the fiscal impact to the state.
  S 2. On or before November 30, 2015, the commissioner  of  health  and
the  superintendent  of  financial  services  shall  complete  the study
conducted pursuant to section one  of  this  act  and  shall  thereafter
deliver  a  copy of the findings of the study and any legislative recom-
mendations they deem to be necessary  to  the  governor,  the  temporary
president of the senate, and the speaker of the assembly.
  S 3. This act shall take effect immediately.

AN ACT to amend the insurance law, in relation to directing the New York
  state health care quality and cost containment commission to study and
  report  upon  the  impact  of  requiring that certain health insurance
  plans provide coverage for treatment of mitochondrial disease

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 213 of the insurance law is amended by adding a new
subdivision (e) to read as follows:
  (E)  THE  COMMISSION SHALL CAUSE A STUDY TO BE PERFORMED ON THE IMPACT
OF REQUIRING CERTAIN HEALTH INSURANCE  PLANS  TO  PROVIDE  COVERAGE  FOR
TREATMENT  OF MITOCHONDRIAL DISEASE. SUCH STUDY SHALL INCLUDE AN ASSESS-
MENT OF THE IMPACT OF SUCH A REQUIREMENT ON COSTS TO PROVIDERS, THE COST
OF INSURANCE PREMIUMS, AND THE FISCAL IMPACT TO THE STATE.  THE  COMMIS-
SION  SHALL SUBMIT A REPORT OF THE FINDINGS, CONCLUSIONS AND RECOMMENDA-
TION OF SUCH STUDY, ON OR BEFORE NOVEMBER THIRTIETH, TWO THOUSAND SEVEN-
TEEN, TO THE GOVERNOR,  THE  TEMPORARY  PRESIDENT  OF  THE  SENATE,  THE
SPEAKER OF THE ASSEMBLY, THE CHAIRS OF THE SENATE AND ASSEMBLY INSURANCE
COMMITTEES, AND THE CHAIRS OF THE SENATE AND ASSEMBLY HEALTH COMMITTEES.
  S 2. This act shall take effect immediately.
