BILL NUMBER:S5596 TITLE OF BILL: An act to amend the village law, in relation to the residency of certain officers of the village of Victory, county of Saratoga PURPOSE: This bill permits the Village of Victory to allow through resolution their village clerk-treasurer and deputy clerk-treasurer reside outside the village in Saratoga County or a county adjoining Saratoga County. SUMMARY OF PROVISIONS: Section one of the bill grants the village board of trustees in the Village of Victory the ability, by resolution, to provide that the village clerk-treasurer and deputy clerk-treasurer may reside outside the village in Saratoga County or a county adjoining Saratoga County. Section two of the bill provides that the act takes effect immediately. JUSTIFICATION: As of the 2000 Census, the Village of Victory had a population of just 544. This bill would provide the village the flexibility to appoint a village clerk-treasurer and/or deputy clerk-treasurer that resides outside the village in Saratoga County or a county adjoining Saratoga County.

Section 3-300 of the village law is amended by adding a new subdivision 22 to read as follows: 22. NOTWITHSTANDING THE PROVISIONS OF THIS CHAPTER OR ANY OTHER GENER- AL LAW, LOCAL LAW, ORDINANCE, OR SPECIAL ACT, THE VILLAGE BOARD OF TRUS- TEES OF THE INCORPORATED VILLAGE OF VICTORY, SARATOGA COUNTY, MAY, BY RESOLUTION, PROVIDE THAT THE VILLAGE CLERK-TREASURER AND DEPUTY CLERK-TREASURER OF THE VILLAGE OF VICTORY, SARATOGA COUNTY, NEED NOT BE A RESIDENT OF SUCH VILLAGE, BUT MUST BE A RESIDENT OF THE COUNTY OF SARATOGA, STATE OF NEW YORK, OR OF A COUNTY WHICH ADJOINS THE COUNTY OF SARATOGA.
