BILL NUMBER:S5601 TITLE OF BILL: An act to amend the environmental conservation law, in relation to establishing the yearling buck protection program PURPOSE: To expand the yearling buck protection program, currently undertaken in parts of Sullivan, Ulster, and Orange Counties, to Wildlife Management Unit 3A, also in Sullivan and Ulster Counties, south and West of State Route 28. SUMMARY OF PROVISIONS: Provides that taking of antlered deer shall be prohibited in WMU 3A, South and West of State Route 28, except when an antlered deer is taken with at least one antler with at least three points; each point must be at least one inch measured from the main antler beam. EFFECTS OF PRESENT LAW WHICH THIS BILL WOULD ALTER: Antler restrictions are not presently in place in WMU 3A, South and West of State Route 28. They are in place in other WMUs in Sullivan and Ulster Counties. BONACIC -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to establishing the yearling buck protection program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The environmental conservation law is amended by adding a new section 11-0914 to read as follows: S 11-0914. YEARLING BUCK PROTECTION PROGRAM. 1. DEFINITIONS. A. AN "ANTLERED DEER" IS DEFINED AS A DEER WITH AT LEAST ONE ANTLER MEASURING THREE INCHES OR MORE IN LENGTH. B. "WILDLIFE MANAGEMENT UNIT" MEANS WILDLIFE REGIONS AS DEMARCATED BY THE DEPARTMENT. 2. RESTRICTIONS AND APPLICATION. A. ANY PERSON WHO HUNTS OR TAKES ANTLERED DEER UNDER A VALID PERMIT OR LICENSE DURING THE BOWHUNTING, REGULAR AND MUZZLELOADING DEER SEASONS IS RESTRICTED TO THE HUNTING OR TAKING OF ANTLERED DEER WITH AT LEAST ONE ANTLER WITH AT LEAST THREE POINTS. EACH POINT MUST BE AT LEAST ONE INCH LONG MEASURED FROM THE MAIN ANTLER BEAM. B. THIS PROGRAM APPLIES TO ALL PUBLIC AND PRIVATE LAND WITHIN THE SPECIFIED WILDLIFE MANAGEMENT UNITS. 3. WILDLIFE MANAGEMENT UNITS. THESE RESTRICTIONS SHALL ONLY APPLY TO THAT PORTION OF WILDLIFE MANAGEMENT UNIT 3A SOUTH AND WEST OF STATE ROUTE TWENTY-EIGHT. 4. EXEMPTIONS FROM REQUIREMENTS. HUNTERS UNDER THE AGE OF SEVENTEEN ARE EXEMPT FROM THE PROVISIONS OF THIS SECTION AND MAY TAKE ANY DEER WITH AN ANTLER OR ANTLERS MEASURING THREE INCHES OR MORE IN LENGTH. S 2.
