  printed to be committed to the Committee on Environmental Conservation

AN ACT to amend the environmental conservation law, in relation  to  the
  powers  of the commissioner of the department of environmental conser-
  vation

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Subdivision  4  of  section  3-0301  of the environmental
conservation law, as added by chapter  719  of  the  laws  of  1981,  is
amended to read as follows:
  4. The commissioner shall:
  (A) cooperate with the commissioner of the state department of health,
district  attorneys and the department of law in providing assistance in
the investigation and prosecution of violations of article  twenty-seven
of this chapter; AND
  (B)  CONSIDER  COMPLIANCE  WITH FEDERAL AND STATE LAWS, REGULATIONS OR
PERMITS GOVERNING THE ENVIRONMENT WHEN RESOLVING A DISPUTE  BETWEEN  TWO
OR MORE MUNICIPALITIES.
  S 2. This act shall take effect immediately.
