TITLE OF BILL: An act to amend the public officers law, in relation to residency requirements for paid firefighters in the city of Utica

PURPOSE: To permit the city of Utica in the county of Oneida to appoint members of the uniformed fire department, including fire alarm dispatchers who reside in Oneida county or within a county that is adjacent to the county of Oneida.

SUMMARY OF PROVISIONS:

Section 1 states that a candidate for hire as a paid member of the uniformed fire department or as a fire dispatcher may reside in the county of Oneida or within a county which is contiguous to the county of Oneida.

Section 2 contains the effective date.

JUSTIFICATION: In an effort to promote a greater pool of candidates and to allow for enhanced flexibility over residency location, this legislation would enable candidates for the position of paid member of the uniformed fire department or fire alarm dispatchers to accomplish their official job duties while residing in the county of Oneida or within a county which is adjacent to the county of Oneida.

GRIFFO -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the public officers law, in relation to residency requirements for paid firefighters in the city of Utica THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3 of the public officers law is amended by adding a new subdivision 60 to read as follows: 60. IN THE CITY OF UTICA IN THE COUNTY OF ONEIDA, NEITHER THE PROVISIONS OF THIS SECTION, NOR OF ANY GENERAL, SPECIAL OR LOCAL LAW, CHARTER, CODE, ORDINANCE, RESOLUTION, RULE OR REGULATION, REQUIRING A PERSON TO BE A RESIDENT OF THE POLITICAL SUBDIVISION OR MUNICIPAL CORPO- RATION OF THE STATE FOR WHICH HE SHALL BE CHOSEN OR WITHIN WHICH HIS OFFICIAL FUNCTIONS ARE REQUIRED TO BE EXERCISED, SHALL APPLY TO THE APPOINTMENT OF A PAID MEMBER OF THE UNIFORMED FORCE OF A PAID FIRE DEPARTMENT, WHO, FOR PURPOSES OF THIS SECTION SHALL INCLUDE PERSONS EMPLOYED AS FIRE ALARM DISPATCHERS, IF SUCH PERSON RESIDES: (A) IN ONEI- DA COUNTY; OR (B) IN A COUNTY WITHIN THE STATE CONTIGUOUS TO ONEIDA COUNTY. S 2. This act shall take effect immediately.
