TITLE OF BILL: An act to amend chapter 618 of the laws of 1998, amending the general municipal law and the education law relating to disposal of surplus computer equipment by political subdivisions, in relation to the effectiveness thereof; and to repeal subdivision 10 of section 318 of the education law relating to reporting on the donations of surplus computers

PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to provide a three year extender for computer donation provisions.

SUMMARY OF SPECIFIC PROVISIONS: This bill extends for three years until July 1, 2016 chapter 618 of the laws of 1998 about donation of computer equipment.

JUSTIFICATION: The enactment of chapter 618 of the laws of 1998 and the extension granted in 2001, 2004, 2007, and 2010 enabled political subdivisions to donate surplus computer equipment through SED's C.R.E.A.T.E. Programs (5318 of the Education law). To date, hundreds of computers have been donated to local schools, libraries and other not-for-profit organizations. This bill will extend this law and allow local governments to continue to dispose of surplus computer equipment in a fair and equitable manner.

PRIOR LEGISLATIVE HISTORY: The Legislature has previously extended this provision.

FISCAL IMPLICATIONS: None.

EFFECTIVE DATE: Immediately, with a three-year sunset provision.

Introduced by Sen. MARTINS -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend chapter 618 of the laws of 1998, amending the general municipal law and the education law relating to disposal of surplus computer equipment by political subdivisions, in relation to the effectiveness thereof; and to repeal subdivision 10 of section 318 of the education law relating to reporting on the donations of surplus computers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3 of chapter 618 of the laws of 1998, amending the general municipal law and the education law relating to the disposal of surplus computer equipment by political subdivisions, as amended by chapter 200 of the laws of 2010, is amended to read as follows: S 3. This act shall take effect immediately and shall expire July 1, [2013] 2016 when upon such date the provisions of this act shall be deemed repealed. S 2 Subdivision 10 of section 318 of the education law is REPEALED. S 3. This act shall take effect immediately; provided, however, that section two of this act shall take effect on July 1, 2013.
