BILL NUMBER:S5711 TITLE OF BILL: An act to amend the social services law, in relation to requiring adult protective services to consult with the local area agency on aging when the individual requiring services is sixty years of age or older PURPOSE: To improve access to local services for seniors in need of adult protective services by requiring adult protective services, when serving an individual age sixty-two or older, to consult with the local area agencies on aging regarding programs and services. SUMMARY OF PROVISIONS: Amends paragraph (a) of subdivision 2 of section 473 of the Social Services Law to require adult protective services, when serving individuals age sixty-two or older, to inform and consult with local area agencies on aging regarding programs and services available to help these individuals. JUSTIFICATION: Effective delivery of adult protective services requires coordination and cooperation among a network of service providers. Current law requires local social services districts to consult with public, private, and voluntary agencies regarding health, mental health, aging, and legal services. This bill would ensure that seniors seeking adult protective services are made aware of all the appropriate, local services that are available to them by requiring adult protective services to consult with local area agencies on

GRIFFO -- read twice and ordered printed, and when printed to be committed to the Committee on Aging AN ACT to amend the social services law, in relation to requiring adult protective services to consult with the local area agency on aging when the individual requiring services is sixty years of age or older THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (a) of subdivision 2 of section 473 of the social services law, as added by chapter 446 of the laws of 1979 and such section as renumbered by chapter 991 of the laws of 1981, is amended to read as follows: (a) (1) In that the effective delivery of protective services for adults requires a network of professional consultants and services providers, local social services districts shall plan with other public, private and voluntary agencies including but not limited to health, mental health, aging, legal and law enforcement agencies, for the purpose of assuring maximum local understanding, coordination and coop- erative action in the provision of appropriate services. (2) IN ACCORDANCE WITH SUBPARAGRAPH ONE OF THIS PARAGRAPH, WHEN THE INDIVIDUAL TO BE SERVED PURSUANT TO THIS SECTION IS SIXTY YEARS OF AGE OR OLDER, THE LOCAL AREA AGENCY ON AGING, EXCEPT IN A CITY WITH A POPU- LATION OF ONE MILLION OR MORE, SHALL BE INFORMED AND CONSULTED ON PROGRAMS AND SERVICES AVAILABLE TO HELP SERVE THE INDIVIDUAL.
