BILL NUMBER:S5714 Revised 05/29/15 TITLE OF BILL: An act to amend the environmental conservation law, in relation to the management of land clearing debris in Nassau and Suffolk counties PURPOSE: To ensure that mulch facilities comply with regulations related to mitigating fire risk, suppressing dust and minimizing odors. SUMMARY OF PROVISIONS: This bill would add a new section 27-0721 to the environmental conservation law. JUSTIFICATION: Currently, facilities that accept only "land clearing debris" are not subject to regulation by the Department of Environmental Conservation; however, these facilities have often been the subject of complaints from adjacent landowners regarding odor and mold problems. In addition, there have been discrepancies as to what constitutes such debris This bill would define land clearing debris and require the adoption of measures to mitigate environmental concerns.
