TITLE OF BILL: An act to amend the environmental conservation law, in relation to authorizing the hunting of big game in the county of Albany with rifles; and providing for the repeal of such provisions upon the expiration thereof

PURPOSE OR GENERAL IDEA OF BILL:

Authorizes big game hunting in Albany County with a pistol, rifle, shotgun, crossbow or long bow for a period of two years.

SUMMARY OF SPECIFIC PROVISIONS:

Section 1 amends Item (d) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law

Section 2 amends Item (d) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law

Section 3 paragraph a of subdivision 2 of section 11-0907 is amended by adding a new item (k)

Section 4 effective date

JUSTIFICATION:

It is currently legal to hunt big game in Albany County with shotgun, muzzleloader, bow and pistol, but not with rifles. This pertains to all areas of the county except Wildlife management Unit 4J is archery only and encompasses the City of Albany and adjacent populated and suburban areas.

Advances in shooting technology with regards to shotguns, including the use of rifled shotgun barrels and specialized ammunition, have given shotguns ballistic characteristics similar to that of rifles.

EFFECTIVE DATE:

This act shall take effect immediately, provided that the amendments to items (d) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law made by section one of this act shall be subject to the expiration and reversion of such paragraph, when upon such date the provisions of section two of this act shall take effect.

Item (d) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law, as amended by section 14 of part EE of chapter 55 of the laws of 2014, is amended to read as follows: (d) Eastern region, Deer, first Monday Pistol, shotgun, cross- except ALBANY, after November 15 bow, muzzle loading Columbia, Fulton, through first Tuesday firearm or Orange, Rensselaer, after December 7 long bow only Saratoga, Washington
Counties and those counties or portions thereof listed in item (i) of this paragraph S 2. Paragraph a of subdivision 2 of section 11-0907 of the environ- mental conservation law is amended by adding a new item (m) to read as follows: (M) THE COUNTY OF DEER, THE FIRST PISTOL, SHOTGUN, CROSS- ALBANY SATURDAY AFTER NOVEMBER BOW, MUZZLE LOADING 15 THROUGH FIRST SUNDAY FIREARM, RIFLE AFTER DECEMBER 7 OR LONG BOW ONLY S 3. This act shall take effect immediately, provided that: (a) the amendments to item (d) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law made by section one of this act shall be subject to the expiration and reversion of such paragraph pursuant to section 13 of chapter 600 of the laws of 1993, as amended; (b) the amendments to paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law made by section two of this act shall be subject to the expiration and reversion of such paragraph pursuant to section 13 of chapter 600 of the laws of 1993, as amended; and (c) nothing contained in this act shall be construed so as to extend the provisions of this act beyond October 1, 2016, when upon such date this act shall expire and the provisions contained herein shall be deemed repealed.
