TITLE OF BILL: An act to amend the environmental conservation law, in relation to the addition of certain lands in the Carmans River Watershed to the Central Pine Barrens Area and the Core Preservation Area; to repeal chapter 538 of the laws of 2011 amending the environmental conservation law relating to the addition of certain lands within the Carmans River Watershed to the core preservation area of the Central Pine Barrens, relating thereto; and to repeal certain provisions of the environmental conservation law relating thereto

PURPOSE: To expand the Central Pine Barrens area and Core preservation area and provide additional protection for the Carmans River Watershed.

SUMMARY OF PROVISIONS:

Section 1. Includes legislative findings that the expansion of the Central Pine Barrens area and Core preservation area will increase protection for the Carmans River and its watershed and benefit the State economy.

Section 2. Repeals subdivisions (10) and (11) of Section 57-0107 of the Environmental Conservation Law This section also adds two new subdivisions, (10) and (11), that describe and bound a new contiguous area of the "Central Pine Barrens area" and "Core preservation area".

Section 3 Repeals Chapter 538 of the Laws of 2011.

Section 4 Contains a severability clause

Section 5. Sets for the effective date.

JUSTIFICATION: The Carmans River is one of the most pristine rivers on Long Island. A Pine Barrens river, it flows ten miles south from Middle Island in the Town of Brookhaven to Great South Bay. Federal, state, county and town property has been preserved to protect its critical habitat. In order to protect the watershed from contamination from groundwater which would result if the land under development pressure were not protected, a plan is being implemented to protect those parcels of land which lie between and connect with already protected parcels. The Pine Barrens Protection Act of 1993 has successfully protected tens of thousands of acres in the Long Island Pine Barrens, so the protection afforded by inclusion of parcels from within the Carmans River watershed under provisions of the Pine Barrens Protection Act will extend the Act's protection to this environmentally sensitive, natural resource.

EFFECTIVE DATE: This act shall take effect on the first of January next succeeding enactment on which it shall have become a law provided that if this act removes any of the lands of the Central Pine Barrens area or the Core preservation area as such lands are described in

Chapter 286 of the Laws of 1998, this act shall be deemed repealed and of no force and effect

LAVALLE, ZELDIN -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to the addition of certain lands in the Carmans River Watershed to the Central Pine Barrens Area and the Core Preservation Area; to repeal chapter 538 of the laws of 2011 amending the environmental conserva- tion law relating to the addition of certain lands within the Carmans River Watershed to the core preservation area of the Central Pine Barrens, relating thereto; and to repeal certain provisions of the environmental conservation law relating thereto THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Legislative findings. The legislature finds that expanding the Central Pine Barrens Area and the core preservation area, as estab- lished in chapter 286 of the laws of 1998 will increase protection for the Carmans River and its watershed and is a vital goal that benefits the environment and the economy of the state. The Carmans River is one of only two found within the Central Pine Barrens. As such, the Carmans River represents a significant and integral part of the Central Pine Barrens ecosystem. Although various state and local measures have been undertaken to protect the Carmans River over the last several decades, recent scientific studies have indicated that existing measures are insufficient to protect the Carmans River. Further, the Carmans River is declining in both the quality of its surface water and its ecological integrity. The entire watercourse of the Carmans River lies within the Central Pine Barrens and much of its groundwater watershed also lies within the Central Pine Barrens and entirely within the town of Brookha- ven. Accordingly, the most effective means of achieving the objectives of environmental preservation of the Carmans River watershed and econom- ic growth on other areas of the town of Brookhaven would be to expand
the core preservation area of the Central Pine Barrens. This legislation is intended to and conditioned on the purpose that it: (1) expand the core preservation area boundary to encompass those areas most critical to the Carmans River; (2) include public parklands and open space areas which are near or currently adjacent to the core preservation area and which should be integrated into the core preservation area; (3) expand the existing Central Pine Barrens area boundary to incorporate the boun- daries of the expanded core preservation area; and shall only remain in effect as long as the description and boundaries of such areas as estab- lished in 1998, and the protections afforded such areas by such act are not diminished in any way. Such intended expansion of the core preserva- tion area will provide significantly more protection to the Carmans River than currently exists and will help to ensure that key ecological values and habitats will be adequately protected, enhanced and main- tained. S 2. Subdivisions 10 and 11 of section 57-0107 of the environmental conservation law are REPEALED, and two new subdivisions 10 and 11 are added to read as follows: 10. S 3. Chapter 538 of the laws of 2011 amending the environmental conservation law relating to the addition of certain lands within the Carmans River Watershed to the core preservation area of the Central Pine Barrens is REPEALED. S 4. Severability. The provisions of this act shall be severable and if any portion thereof or the applicability thereof to any person or circumstances shall be held invalid, the remainder of this act and the application thereof shall not be affected thereby. S 5. This act shall take effect on the first of January next succeed- ing the date on which it shall have become a law provided that if the provisions of this act establishing a new description and boundaries of the Central Pine Barrens Area or the core preservation area removes or excludes any of the lands of the Central Pine Barrens Area or the core preservation area as such lands are described and bounded in chapter 286 of the laws of 1998, and/or protections established and/or provided by such act, this act shall be deemed repealed and of no force and effect and chapter 286 of the laws of 1998 shall remain in full force and effect. The state legislature shall notify the legislative bill drafting commission of any such decrease and resulting repeal in order that the commission may maintain an accurate and timely effective data base of the official text of the laws of the state of New York in furtherance of effectuating the provisions of section 44 of the legislative law and section 70-b of the public officers law.
