                                BILL NUMBER:S5731

TITLE OF BILL:  An act to amend the public officers law, in relation
to personally identifiable information and certain researchers; and to
amend the public health law, in relation to unlawful interference with
research laboratory operations

PURPOSE:  To increase privacy protections related to the personally
identifiable and other similar information of certain researchers and
to establish penalties for the interference with research.

SUMMARY OF PROVISIONS:

Section one amends subdivision 2 of section 87 of the public officers
law to add a specific exemption to the freedom of information law to
protect personally identifiable information or other information not
generally available to the public when such information is contained
in records relating to research.

Section two amends subdivision 2 of section 96 to the public officers
law by adding a new paragraph (e) which makes a similar and conforming
change to the personal privacy protection law.

Section three amends the public health law by adding a new section 506
which establishes the crime of unlawful interference with research
laboratory operations.

Section four establishes the effective date as immediately.

JUSTIFICATION:  New York is home to a number of world class biomedical
research institutions. The work being done in state is often at the
forefront of biomedical science and is quite literally saving lives.
Unfortunately, researchers across the country have found themselves
the target of individuals and groups who are opposed to the work they
are doing for any number of reasons Researchers have received
threatening letters, have been the victims of vandalism, cyber
harassment and, in the most egregious circumstances, they and their
families have been the victims of violence. The purpose of this
legislation is two-fold. First, it adds language to the freedom of
information law and the personal privacy protection law to ensure that
personal information or other generally non-public information is not
accessible. Second, it establishes penalties for unlawful interference
with research, creating a more cohesive mechanism by which to address
the criminal activity of those who seek to disrupt research, threaten,
harass or even harm researchers. A number of states, most notably
California, in the wake of a number of violent incidents, have taken
similar action in order to support and protect their researchers. New
York, as a leader in biomedical research, certainly should be
pro-active on this important issue.

AN ACT to amend the public officers law, in relation to personally iden-

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 2 of section 87 of the public officers  law  is
amended by adding a new paragraph (m) to read as follows:
  (M)  ARE  RECORDS CONCERNING RESEARCH, INCLUDING ACTUAL RESEARCH DOCU-
MENTS, CONDUCTED UNDER THE AUSPICES OF A RESEARCH  LABORATORY,  AS  THAT
TERM  IS  DEFINED  IN SECTION FIVE HUNDRED SIX OF THE PUBLIC HEALTH LAW,
THAT CONTAIN PERSONALLY IDENTIFIABLE INFORMATION  OR  OTHER  INFORMATION
NOT GENERALLY AVAILABLE TO THE GENERAL PUBLIC.
  S 2. Subdivision 2 of section 96 of the public officers law is amended
by adding a new paragraph (e) to read as follows:
  (E)  PERSONAL  INFORMATION  OR OTHER INFORMATION THAT IS NOT GENERALLY
AVAILABLE TO THE PUBLIC RELATING TO RESEARCH  CONDUCTED  AT  A  RESEARCH
LABORATORY  AS  THAT  TERM IS DEFINED IN SECTION FIVE HUNDRED SIX OF THE
PUBLIC HEALTH LAW.
  S 3. The public health law is amended by adding a new section  506  to
read as follows:
  S  506.  UNLAWFUL INTERFERENCE WITH RESEARCH LABORATORY OPERATIONS. 1.
DEFINITIONS. FOR THE PURPOSES OF THIS SECTION, THE FOLLOWING TERMS SHALL
HAVE THE FOLLOWING MEANINGS:
  (A) "RESEARCH LABORATORY" MEANS ANY BUILDING,  STRUCTURE,  LABORATORY,
VEHICLE,  PASTURE,  PADDOCK,  POND,  IMPOUNDMENT  OR  PREMISES REGULATED
PURSUANT TO THIS ARTICLE AT WHICH LEGAL BIOMEDICAL RESEARCH OR  TEACHING

 EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                      [ ] is old law to be omitted.

IS  CONDUCTED  OR  ATTEMPTED  OR  WHERE RECORDS OR DOCUMENTS RELATING TO
EXPERIMENTS, PRODUCTION, EDUCATION OR INVESTIGATION ARE MAINTAINED.
  (B) "FAMILY OR HOUSEHOLD MEMBER" MEANS A SPOUSE, FAMILY MEMBER, FORMER
SPOUSE, PARENT, CHILD, PERSONS RELATED BY BLOOD OR MARRIAGE, PERSONS WHO
ARE IN A DATING RELATIONSHIP, PERSONS WHO ARE PRESENTLY RESIDING TOGETH-
ER OR WHO HAVE RESIDED TOGETHER IN THE PAST, PERSONS WHO HAVE A CHILD IN
COMMON  REGARDLESS  OF  WHETHER  THEY  ARE OR HAVE BEEN MARRIED OR LIVED
TOGETHER AT ANY TIME.
  (C) "RESEARCHER" MEANS A  PERSON  ENGAGED  IN,  OR  PROVIDING  SUPPORT
SERVICES FOR A PERSON ENGAGED IN LEGAL BIOMEDICAL RESEARCH OR TEACHING.
  2. UNLAWFUL TAMPERING WITH BIOMEDICAL RESEARCH OCCURS WHEN AN INDIVID-
UAL:
  (A) WITH THE INTENT TO INTERFERE WITH RESEARCH, DAMAGES, VANDALIZES OR
STEALS  ANY  PROPERTY  IN  OR  ON  A RESEARCH LABORATORY, OR ANY REAL OR
PERSONAL PROPERTY  OF  A  PERSON  OR  ENTITY  HAVING  A  CONNECTION  TO,
RELATIONSHIP WITH, OR TRANSACTIONS WITH A RESEARCH LABORATORY;
  (B)  WITH  THE INTENT TO INTERFERE WITH THE OPERATIONS, OBTAINS ACCESS
TO A RESEARCH LABORATORY TO PERFORM ACTS NOT AUTHORIZED BY THAT RESEARCH
LABORATORY;
  (C) OBTAINS OR EXERTS UNAUTHORIZED CONTROL OVER RECORDS, DATA, MATERI-
ALS OR EQUIPMENT OF ANY RESEARCH LABORATORY WITH THE INTENT TO INTERFERE
WITH RESEARCH BY CONCEALING,  ABANDONING  OR  DESTROYING  SUCH  RECORDS,
DATA, MATERIALS OR EQUIPMENT;
  (D)  WITH  THE  INTENT  TO  INTERFERE WITH RESEARCH, POSSESSES OR USES
RECORDS,  DATA,  MATERIALS  OR  EQUIPMENT  THAT  THE  PERSON  REASONABLY
BELIEVES  HAVE BEEN OBTAINED BY THEFT OR DECEPTION FROM A RESEARCH LABO-
RATORY OR WITHOUT THE AUTHORIZATION OF A RESEARCH LABORATORY;
  (E) PUBLISHES INFORMATION DESCRIBING OR DEPICTING  A  RESEARCHER,  THE
RESEARCHER'S  FAMILY  OR  HOUSEHOLD  MEMBER  OR  THE  LOCATION  WHERE  A
RESEARCHER OR FAMILY OR HOUSEHOLD MEMBER MAY BE FOUND, WITH  THE  INTENT
THAT A PERSON IMMINENTLY USE THE INFORMATION TO COMMIT A CRIME INVOLVING
VIOLENCE  OR  A  THREAT  OF VIOLENCE AGAINST THE RESEARCHER OR FAMILY OR
HOUSEHOLD MEMBER AND THE INFORMATION IS LIKELY TO AID  IN  THE  IMMINENT
COMMISSION OF THE CRIME;
  (F) COMMITS THE CRIME OF AGGRAVATED HARASSMENT IN THE SECOND DEGREE AS
DEFINED  BY SECTION 240.30 OF THE PENAL LAW WITH THE INTENT TO INTERFERE
WITH RESEARCH OR INTIMIDATE A RESEARCHER.
  3. UNLAWFUL TAMPERING WITH BIOMEDICAL RESEARCH IS  A  CLASS  E  FELONY
PUNISHABLE IN ACCORDANCE WITH THE PENAL LAW.
  S 4. This act shall take effect immediately.

PURPOSE:

To increase safety and security protections related to the personally
identifiable and other similar information of certain researchers and
to establish penalties for the interference with research.

SUMMARY OF PROVISIONS:

Section one amends subdivision 2 of section 87 of the public officers
law by adding a new paragraph n relating to research under the
auspicies of a research laboratory that if disclosed would jeopardize
the safety or security of a research laboratory, its employees, or
family members of its employees.

Section two amends the public health law by adding a new section 506
which establishes the crime of unlawful interference with research
laboratory operations.

Section three establishes the effective date as immediately.

DEPARTMENT  OR AT AN INSTITUTION WITHIN THE STATE THAT RECEIVES STATE OR
FEDERAL FUNDING TO CONDUCT SUCH BIOMEDICAL RESEARCH OR  SUCH  BIOMEDICAL
TEACHING  THAT,  IF  DISCLOSED, COULD ENDANGER THE LIFE OR SAFETY OF ANY
PERSON OR WOULD BE REASONABLY LIKELY TO ENDANGER THE  SECURITY  OF  SUCH
