BILL NUMBER:S5748 TITLE OF BILL: An act to amend the criminal procedure law, in relation to designating court attendants employed by the town or village of Harrison as peace officers PURPOSE OR GENERAL IDEA OF THE BILL: To allow employees of the town or village of Harrison serving as court attendants in the courts of the town or village of Harrison to serve as peace officers. SUMMARY OF SPECIFIC PROVISIONS: Section one of the bill amends section 2.10 of the criminal procedure law by adding a new subdivision 83 to include within the designation of peace officer employees of the town or village of Harrison serving as court attendants in the courts of the town or village of Harrison. JUSTIFICATION: Municipalities in the State of New York are under intense pressure to reduce operating costs to keep already strained municipal budgets in balance and to keep future property tax increases at a minimum. Accordingly, the purpose of this legislation is to allow the town or village of Harrison to use certain employees

OPPENHEIMER -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the criminal procedure law, in relation to designating court attendants employed by the town or village of Harrison as peace officers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2.10 of the criminal procedure law is amended by adding a new subdivision 83 to read as follows: 83. EMPLOYEES OF THE TOWN OR VILLAGE OF HARRISON SERVING AS COURT ATTENDANTS IN THE COURTS OF THE TOWN OR VILLAGE OF HARRISON; PROVIDED, HOWEVER, THAT NOTHING IN THIS SUBDIVISION SHALL BE DEEMED TO AUTHORIZE SUCH EMPLOYEES TO CARRY, POSSESS, REPAIR OR DISPOSE OF A FIREARM UNLESS THE APPROPRIATE LICENSE THEREFORE HAS BEEN ISSUED PURSUANT TO SECTION 400.00 OF THE PENAL LAW.
