BILL NUMBER:S5804 TITLE OF BILL: An act to amend the retirement and social security law, in relation to service retirement benefits for persons engaged in criminal law enforcement and employed in the office of district attorney of Tompkins county PURPOSE: To amend the retirement and social security law, in relation to service retirement benefits for persons engaged in criminal law enforcement and employed in the office of the district attorney of Tompkins County. SUMMARY OF PROVISIONS: The bill adds subdivision u to section 603 of the retirement and social security law to allow the County of Tompkins to adopt at its own option a twenty-year retirement plan for Detective Investigators within the office of the Tompkins County District Attorney. EXISTING LAW: Section 603 of the retirement and social security law. JUSTIFICATION: Tomkins County seeks the option to provide retirement benefits for anyone employed in the office of the District Attorney as chief

O'MARA -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the retirement and social security law, in relation to service retirement benefits for persons engaged in criminal law enforcement and employed in the office of district attorney of Tomp- kins county THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 603 of the retirement and social security law is amended by adding a new subdivision u to read as follows: U. IF THE COUNTY OF TOMPKINS ELECTS TO PROVIDE A RETIREMENT BENEFIT BY ADOPTING A RESOLUTION TO SUCH EFFECT AND FILING A CERTIFIED COPY THEREOF WITH THE COMPTROLLER, THE SERVICE RETIREMENT BENEFIT SPECIFIED IN SECTION SIX HUNDRED FOUR OF THIS ARTICLE SHALL BE PAYABLE TO MEMBERS WITH TWENTY YEARS OF CREDITABLE SERVICE, WITHOUT REGARD TO AGE, WHO ARE ENGAGED DIRECTLY IN CRIMINAL LAW ENFORCEMENT ACTIVITIES AND WHO ARE EMPLOYED IN THE OFFICE OF THE DISTRICT ATTORNEY OF TOMPKINS COUNTY AS A CHIEF CRIMINAL INVESTIGATOR/DETECTIVE, DEPUTY CHIEF CRIMINAL INVESTI- GATOR, CRIMINAL INVESTIGATOR, SENIOR CRIMINAL INVESTIGATOR, CONFIDENTIAL CRIMINAL INVESTIGATOR, ASSISTANT CRIMINAL INVESTIGATOR, CRIMINAL INVES- TIGATOR-ELECTRONICS, CRIMINAL INVESTIGATOR-CHILD ABUSE, CONFIDENTIAL INVESTIGATOR OR CRIMINAL INVESTIGATOR/ARSON IF: (I) SUCH MEMBERS HAVE MET THE MINIMUM SERVICE REQUIREMENTS UPON RETIREMENT, AND (II) IN THE CASE OF A MEMBER SUBJECT TO THE PROVISIONS OF ARTICLE FOURTEEN OF THIS CHAPTER, SUCH MEMBER FILES AN ELECTION THEREFOR WHICH PROVIDES THAT HE OR SHE WILL BE SUBJECT TO THE PROVISIONS OF THIS ARTICLE AND TO NONE OF THE PROVISIONS OF ARTICLE FOURTEEN OF THIS CHAPTER. SUCH ELECTION, WHICH SHALL BE IRREVOCABLE, SHALL BE IN WRITING, DULY EXECUTED AND SHALL BE FILED WITH THE COMPTROLLER, WITHIN THREE YEARS AFTER ENTERING EMPLOYMENT IN THE OFFICE OF THE DISTRICT ATTORNEY OF TOMPKINS COUNTY IN ONE OF THE TITLES AFOREMENTIONED IN THIS SUBDIVISION.
