BILL NUMBER:S5808 TITLE OF BILL: An act to amend the town law, in relation to diminishing the Kiamesha Lake sewer district PURPOSE OR GENERAL IDEA OF BILL: Authorizes the Town Board of the Town of Thompson, in the County of Sullivan, to diminish the area of the Kiamesha Lake Sewer District. SUMMARY OF SPECIFIC PROVISIONS: Section 1: Amends section 202-c of the Town Law by adding a new subdivision 11 to state that the Town of Thompson shall be authorized to diminish the Kiamesha Lake Sewer District by deleting certain parcels. It also lists which tax lot numbers are authorized to be deleted Section 2: Effective date. JUSTIFICATION: This bill was introduced at the request of the Town of Thompson.

BONACIC -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the town law, in relation to diminishing the Kiamesha Lake sewer district THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 202-c of the town law is amended by adding a new subdivision 11 to read as follows: 11. (A) NOTWITHSTANDING ANY OTHER PROVISION OF GENERAL, SPECIAL OR LOCAL LAW, RULE, OR REGULATION TO THE CONTRARY, WHENEVER THE TOWN BOARD OF THE TOWN OF THOMPSON, SULLIVAN COUNTY SHALL DETERMINE IT TO BE IN THE PUBLIC INTEREST, SAID TOWN BOARD MAY, UPON ITS OWN MOTION AND WITHOUT A PETITION, BUT AFTER A PUBLIC HEARING HELD IN THE MANNER AND UPON THE NOTICE SPECIFIED IN SUBDIVISION ONE OF THIS SECTION, DIMINISH THE KIAME- SHA LAKE SEWER DISTRICT BY DELETING THEREFROM THE PARCELS LISTED IN PARAGRAPH (B) OF THIS SUBDIVISION LOCATED IN THE TOWN OF THOMPSON AND PRESENTLY INCLUDED IN SAID DISTRICT. IN ADDITION, ANY ORDER ADOPTED BY THE TOWN BOARD PURSUANT TO THIS SUBDIVISION SHALL BE SUBJECT TO A PERMISSIVE REFERENDUM PURSUANT TO ARTICLE SEVEN OF THIS CHAPTER. SUMMARY OF SPECIFIC PROVISIONS: Section 1:Authorizes the town board of the Town of Thompson to diminish the Kiamesha Lake Sewer District by deleting certain parcels; provided that a new district encompassing such parcels is established that will assume any indebtedness attributable to the parcels which were deleted from the Kiamesha Lake Sewer District. S 2.
