TITLE OF BILL: An act to amend chapter 350 of the laws of 2012 relating to the conveyance of land formerly used as an armory to the town of Brookhaven, county of Suffolk, in relation to the application by the town of Brookhaven for the transfer or conveyance of such land

PURPOSE OR GENERAL IDEA OF BILL: This bill will extend the amount of time that the town of Brookhaven has, from one to three years, to act on the transfer of certain real property on Barton Avenue, in North Patchogue, which was previously used as an Armory.

SUMMARY OF SPECIFIC PROVISIONS:

Section 1 amends section 3 of chapter 350 of the laws of 2012, relating to the conveyance of land formerly used as an armory, to the town of Brookhaven.

Section 2 is the effective date.

JUSTIFICATION: Chapter 350 of the laws of 2012 allowed the Commissioner of OGS to transfer real property, formerly used as an Armory, to the town of Brookhaven for use by the community. However, the town was only given one year to make an application to OGS for the transfer.

To date, the town has been unable to make the application because they are awaiting completion of an environmental audit, budget analysis, building and fire inspection, and an appropriate intermunicipal agreement. This bill will allow the town additional time so that they can complete the necessary analysis before applying to OGS for the conveyance.

PRIOR LEGISLATIVE HISTORY: New legislation.

ZELDIN -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend chapter 350 of the laws of 2012 relating to the convey- ance of land formerly used as an armory to the town of Brookhaven, county of Suffolk, in relation to the application by the town of Brookhaven for the transfer or conveyance of such land THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3 of chapter 350 of the laws of 2012 relating to the conveyance of land formerly used as an armory to the town of Brook- haven, county of Suffolk, is amended to read as follows: S 3. The commissioner of general services shall not transfer or convey the aforesaid land unless application is made by the town of Brookhaven within [one year] THREE YEARS after the effective date of this act. S 2. This act shall take effect immediately.
