AN ACT to amend the vehicle and traffic law,  in  relation  to  defining
  commuter van vehicles, liveries, and taxicabs

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 121-e of the vehicle and traffic law, as  added  by
chapter 15 of the laws of 1983, is amended to read as follows:
  S 121-e. Livery.  Every motor vehicle, INCLUDING COMMUTER VANS OPERAT-
ING WITH STATE AND/OR FEDERAL AUTHORITY, other than a taxicab or a  bus,
used in the business of transporting passengers for compensation. Howev-
er,  it  shall not include vehicles which are rented or leased without a
driver.
  S 2. The vehicle and traffic law is amended by adding  a  new  section
108-a to read as follows:
  S  108-A.  COMMUTER  VAN  VEHICLE.  AS  USED IN THIS CHAPTER, THE TERM
"COMMUTER VAN VEHICLE" SHALL MEAN A MOTOR VEHICLE WITH A DRIVER HAVING A
SEATING CAPACITY OF AT LEAST NINE BUT NOT MORE THAN FOURTEEN  PASSENGERS
TO CARRY PASSENGERS FOR HIRE IN AN AUTHORIZED COMMUTER VAN SERVICE.
  S 3. Section 148-a of the vehicle and traffic law, as amended by chap-
ter 15 of the laws of 1983, is amended to read as follows:
  S 148-a. Taxicab. Every motor vehicle, other than a bus AND A COMMUTER
VAN VEHICLE, used in the business of transporting passengers for compen-
sation,  and  operated in such business under a license or permit issued
by a local authority. However, it shall not include vehicles  which  are
rented or leased without a driver.
  S 4. This act shall take effect immediately.

                      [ ] is old law to be omitted.

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

OF TRANSPORTATION OR FEDERAL INTERSTATE AUTHORITY FROM THE UNITED STATES
DEPARTMENT OF TRANSPORTATION, other than a taxicab or a bus, used in the
business  of transporting passengers for compensation. However, it shall
not include vehicles which are rented or leased without a driver.
  S 2. The vehicle and traffic law is amended by adding  a  new  section
108-a to read as follows:
  S  108-A.  COMMUTER  VAN  VEHICLE.  AS  USED IN THIS CHAPTER, THE TERM

AN  ACT  to amend the vehicle and traffic law, in relation to the regis-
  tration of commuter vans

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Schedule C of subdivision 7 of section 401 of the vehicle
and traffic law, as amended by section 8 of part G of chapter 59 of  the
laws of 2009, is amended to read as follows:
  C.  Schedule  for  taxicabs  and livery. 1. For each taxicab or livery
having a seating capacity for passengers, excluding the driver, of  five
persons  or  less,  the annual fee of thirty-one dollars and sixty-three
cents. For each such vehicle having a seating capacity  for  passengers,
excluding  the driver, of not less than six persons, nor more than seven
persons, the annual fee of fifty-one dollars and seventy-five cents. For
each such vehicle having a seating capacity  for  passengers,  excluding
the  driver,  of  at least eight persons, but not more than ten persons,
the annual fee of sixty-four dollars and sixty-nine cents. For each such
vehicle having a seating capacity for passengers, excluding the  driver,
of  at  least  eleven  persons,  but not more than fourteen persons, the
annual fee of ninety-two dollars. Any registration  issued  pursuant  to
this  schedule  shall  be  revoked upon receipt by the commissioner of a
notice of revocation of any license or permit necessary for the issuance
of such registration from the local authority which issued such  license
or  permit,  or  upon  receipt  of evidence by the commissioner that the
registrant has been convicted of a violation of any local law  requiring
the issuance of a license or permit in order to engage in for-hire oper-
ation. Provided, however, that upon surrender to the commissioner of any
