TITLE  OF  BILL:    An  act  to amend chapter 118 of the laws of 1969,
relating to a separate union free  school  district  in  the  town  of
Greenburgh,  in  the  county of Westchester, in relation to clarifying
the authority  of  the  Greenburgh  North  Castle  Union  Free  School
District to lease certain properties and to expand its boundaries

PURPOSE  OR  GENERAL  IDEA  OF  BILL:  The  purpose of this bill is to
authorize the Greenburgh North Castle union free  school  district  to
lease  properties  and  expand  its  boundaries  for  the  purpose  of
providing instruction to students in the Greenburgh North Castle union
free school district,

SUMMARY OF SPECIFIC PROVISIONS: Section 2-a authorizes the  lease  and
expansion of boundaries of properties located at 108 Shonnard Place in
the  city  of  Yonkers, county of Westchester, and at 1700 Old Orchard
Place in the village  of  Valhalla,  county  of  Westchester  for  the
purpose  of  providing  instruction to students enrolled in the school
district.

Section 2-b authorizes  the  lease  and  expansion  of  boundaries  of
properties  located at 623 Blooming Grove Turnpike, in the town of New
Windsor, county of Orange, to be known as the  Kaplan  Center  Academy
for  the  purpose of providing instruction to students enrolled in the
school district.

Section 3 states that Chapter 118 of the laws of 1969  is  amended  by
adding  a  new  section  2-c.  Section  2-c of the bill authorizes the
Greenburgh  North  Castle  union  free  school  district,  subject  to
approval  of  the  New  York  State  education  department,  to  lease
properties and expand boundaries of  properties  located  at  45  East
Gainsborg   Avenue   in  the  village  of  West  Harrison,  county  of
Westchester to be known as the REACH Academy and  to  enter  into  any
agreements  necessary  for  the  purpose  of  providing instruction to
students enrolled in the Greenburgh North  Castle  union  free  school
district

Section 4 ratifies, validates and confirms the actions of the board of
education  of  the  Greenburgh  North  Castle  union  free district in
entering into a lease of  properties  located  at  45  East  Gainsborg
Avenue  notwithstanding  its  location  outside of the school district
boundaries.

JUSTIFICATION:  This legislation is necessary to allow the  Greenburgh
North Castle Union Free School District to lease properties and expand
their school boundaries.

AN ACT to amend chapter 118 of the laws of 1969, relating to a  separate
  union free school district in the town of Greenburgh, in the county of
  Westchester, in relation to clarifying the authority of the Greenburgh
  North  Castle  Union  Free School District to lease certain properties
  and to expand its boundaries

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.   Section 2-a of chapter 118 of the laws of 1969, relating
to a separate union free school district in the town  of  Greenburgh  in
the  county of Westchester, as added by chapter 224 of the laws of 2010,
is amended to read as follows:
  S 2-a.   Notwithstanding any other law, rule,  or  regulation  to  the
contrary,  in addition to the powers granted by section two of this act,
subject to the approval of the New York state education department,  the
board  of  education shall be authorized to lease properties, AND EXPAND
THE BOUNDARIES OF THE SCHOOL DISTRICT FOR THE DURATION OF ANY LEASES  TO
INCLUDE,  PROPERTIES  located at 108 Shonnard Place in the city of Yonk-
ers, county of Westchester, and TO LEASE PROPERTIES LOCATED at 1700  Old
Orchard  Place in the village of Valhalla, county of Westchester for the
purpose of providing instruction to  students  enrolled  in  the  school
district.
  S  2.  Section  2-a  of chapter 118 of the laws of 1969, relating to a
separate union free school district in the town of  Greenburgh,  in  the
county  of  Westchester, as added by chapter 226 of the laws of 2010, is
amended to read as follows:
  S [2-a] 2-B.  Notwithstanding any other law, rule,  or  regulation  to
the  contrary,  in addition to the powers granted by section two of this
act, subject to the approval of the New York state education department,
the board of education shall be authorized to lease AND  EXPAND  BOUNDA-

RIES  OF  THE  SCHOOL DISTRICT FOR THE DURATION OF ANY LEASES TO INCLUDE
properties located at 623 Blooming Grove Turnpike, in the  town  of  New
Windsor, county of Orange, TO BE KNOWN AS THE KAPLAN CAREER ACADEMY, for
the  purpose of providing instruction to students enrolled in the school
district.
  S 3. Chapter 118 of the laws of 1969, relating  to  a  separate  union
free  school  district in the town of Greenburgh, in the county of West-
chester, is amended by adding a new section 2-c to read as follows:
  S 2-C. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, RULE OR  REGULATION
TO THE CONTRARY, SUBJECT TO THE APPROVAL OF THE NEW YORK STATE EDUCATION
DEPARTMENT,  THE  BOARD  OF  EDUCATION  SHALL BE AUTHORIZED TO LEASE AND
EXPAND THE BOUNDARIES OF THE SCHOOL DISTRICT FOR  THE  DURATION  OF  ANY
LEASE  TO  INCLUDE PROPERTIES LOCATED AT 45 EAST GAINSBORG AVENUE IN THE
VILLAGE OF WEST HARRISON, COUNTY OF WESTCHESTER,  TO  BE  KNOWN  AS  THE
REACH  ACADEMY,  AND TO ENTER INTO ANY AGREEMENTS NECESSARY TO CARRY OUT
SUCH AUTHORITY, FOR THE PURPOSE OF  PROVIDING  INSTRUCTION  TO  STUDENTS
ENROLLED IN THE GREENBURGH NORTH CASTLE UNION FREE SCHOOL DISTRICT.
  S  4.  The  actions  of the board of education of the Greenburgh North
Castle union free school district in entering into a lease of properties
located at 45 East Gainsborg Avenue in the  village  of  West  Harrison,
county of Westchester, prior to the effective date of this act are here-
by  ratified,  validated  and  confirmed  notwithstanding  its  location
outside of the school district boundaries.
  S 5. This act shall take effect July 1, 2013,  provided  that  in  the
event  it shall become a law after such date, this act shall take effect
immediately and shall be deemed to have been in full force and effect on
and after July 1, 2013.
