BILL NUMBER:S5841 TITLE OF BILL: An act to amend the public service law, in relation to a community solar pilot program PURPOSE: This legislation would establish a pilot program to allow electric customers to subscribe to their utility to purchase solar power as a portion of their basic service. SUMMARY OF PROVISIONS: Section one would establish the New York state community solar pilot program. The Public Service Commission (PSC) would be directed to administer the implementation of the solar pilot program, which would require electric corporations to: *Own or hold a long-term lease on the real property on which a solar facility would be connected, provided that such facility is located strategically with the electric grid; *Issue a request for proposal for construction of such facilities; *Provide opportunities for customers to participate in the solar pilot program on a first come, first serve basis and provide that a

GRIFFO -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommuni- cations AN ACT to amend the public service law, in relation to a community solar pilot program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public service law is amended by adding a new section 66-o to read as follows: S 66-O. NEW YORK STATE COMMUNITY SOLAR PILOT PROGRAM. 1. THE COMMIS- SION SHALL ESTABLISH THE NEW YORK STATE COMMUNITY SOLAR PILOT PROGRAM TO AUTHORIZE THE DEVELOPMENT OF UP TO FIFTY MEGAWATTS OF COMMUNITY SOLAR CAPACITY STATEWIDE, STRIVING FOR A REGIONAL BALANCE, IN ORDER TO STIMU- LATE THE GROWTH OF COMMUNITY SOLAR, USING A SUBSCRIPTION-BASED MODEL WHICH OFFERS ENERGY FOR A FIXED PERIOD OF YEARS, WITH ELECTRIC CORPO- RATION OWNERSHIP AND MANAGEMENT. ANY SUBSCRIPTION PARTICIPATION BY ELEC- TRIC CORPORATIONS SHALL BE ON A DEFAULT BASIS ONLY IN THE EVENT OF UNSOLD SUBSCRIPTIONS. 2. THE COMMISSION SHALL OVERSEE AND APPROVE THE IMPLEMENTATION OF COMMUNITY SOLAR PILOT PROGRAMS BY ELECTRIC CORPORATIONS WHICH SHALL INCLUDE THE FOLLOWING ELEMENTS: (A) ELECTRIC CORPORATIONS SHALL OWN OR HAVE A LONG-TERM LEASE ON THE REAL PROPERTY WHERE A SOLAR ARRAY WILL BE CONSTRUCTED AND SUCH LOCATION SHALL BE STRATEGICALLY LOCATED SO AS TO ALLOW FOR AN OPTIMIZED AND MORE SECURE AND FLEXIBLE ELECTRIC POWER SYSTEM. (B) THE ELECTRIC CORPORATION SHALL OWN THE SOLAR PANELS AND OTHER INFRASTRUCTURE REQUIRED TO INTEGRATE THE ELECTRICITY PRODUCED EFFEC- TIVELY INTO THE GRID CONNECTING TO THE ELECTRIC SYSTEM WHICH SHALL BE INTERCONNECTED AND OPERATED IN PARALLEL WITH THE ELECTRIC CORPORATION'S DISTRIBUTION FACILITIES. BILL NUMBER: S5841A TITLE OF BILL : An act to amend the public service law, in relation to a community renewable facility pilot program PURPOSE OR GENERAL IDEA OF BILL : This legislation would establish a pilot program to allow electric customers to subscribe to their utility to purchase power produced from community renewable energy facilities as a portion of their basic service. SUMMARY OF SPECIFIC PROVISIONS : Section one would: *Define "community renewable energy facility" to mean solar electric generating equipment, wind electric generating equipment and hydroelectric generating equipment not to exceed ten megawatts, which an electric corporation is authorized to own and operate" *Establish the New York state community renewable energy facility program.
