BILL NUMBER:S5844 TITLE OF BILL: An act in relation to authorizing school buses and paratransit vehicles types A(I) and A(II) used solely for the transportation of children or people with disabilities to travel on parkways PURPOSE OR GENERAL IDEA OF BILL: to allow small school buses and paratransit vehicles types A(I) and A(II) to travel on state parkways when transporting children or people with disabilities. SUMMARY OF SPECIFIC PROVISIONS: Section 1 of this bill authorizes school buses and paratransit vehicles type A(I) and A(II) to travel state parkways when transporting children with disabilities or children. Section 2. Effective Date. JUSTIFICATION: The State's parkway system originally was created to provide a scenic way into, or out of, and around New York City. But today, the state parkways are for the most part equivalent to expressways, except for a
few oddities, such as low, stone-arch overpasses that would trap trucks, commercial vehicles and tractor trailers, which is why they are banned from parkways. Due to the parkways' banning of commercial vehicles, trucks, and tractor trailers, mini school buses and paratransit buses, type A(I) and A(II), which clear these overpasses, are banned from traveling the parkways. Often times these vehicles are transporting children and people with disabilities. Banning these vehicles from parkways, in cases when transporting children and people with disabilities, can often times double the commute times for these groups. This legislation would allow for these specific types of vehicles to travel on the state's parkways while transporting children and people with disabilities. These populations suffer the most by the lengthy travel times they are subjected to by not allowing mini school buses and paratransit vehicles to travel the parkways. PRIOR LEGISLATIVE HISTORY: New Bill. FISCAL IMPLICATIONS: None to the State. EFFECTIVE DATE: Immediately.

BOYLE -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT in relation to authorizing school buses and paratransit vehicles types A(I) and A(II) used solely for the transportation of children or people with disabilities to travel on parkways THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of general, special or local law, rule or regulation to the contrary, school buses and para- transit vehicles types A(I) and A(II) used solely for the transportation of children or people with disabilities shall be authorized to travel on all parkways, regardless of limitations on commercial traffic on such parkways.
