TITLE OF BILL: An act to amend the social services law, in relation to the statewide central register of child abuse and maltreatment

PURPOSE GENERAL IDEA OF BILL: To amend Section 422 5(a)(v) of the Social Services law to replace reference to Penal Law Section 240.55 with reference to Section 240.50 of the Penal Law.

SUMMARY OF SPECIFIC PROVISIONS:

Section 1 amends Section 422 5(a)(v) of the Social Services law to replace reference to Penal Law Section 240.55 with reference to Section 240.50 of the Penal Law.

Section 2 contains the effective date.

JUSTIFICATION: This statement is intended to reference falsely reporting child abuse, however, the current reference to section 240.55 of the Penal Law refers to making a bomb threat. This legislation corrects this error and references the appropriate section of Penal Law.

PRIOR LEGISLATIVE HISTORY: This is a new bill.

FISCAL IMPLICATIONS: None.

EFFECTIVE DATE: This act shall take effect immediately.

Introduced by Sen. ROBACH -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the social services law, in relation to the statewide central register of child abuse and maltreatment THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph (v) of paragraph (a) of subdivision 5 of section 422 of the social services law, as amended by chapter 555 of the laws of 2000, is amended to read as follows: (v) to a district attorney, an assistant district attorney, an inves- tigator employed in the office of a district attorney, or to a sworn officer of the division of state police, of a city, county, town or village police department or of a county sheriff's office when such official verifies that the report is necessary to conduct an active investigation or prosecution of a violation of subdivision [three] FOUR of section [240.55] 240.50 of the penal law. S 2. This act shall take effect immediately.
