BILL NUMBER: S5856 TITLE OF BILL : An act to amend the real property tax law, in relation to notifying certain tenants of the senior citizen rent increase exemption program and the disability rent increase exemption program PURPOSE : To ensure that eligible tenants who qualify for the Senior Citizen Rent Increase Exemption (SCRIE) and the Disability Rent Increase Exemption (DRIE) programs are made aware of such benefits with their annual lease. SUMMARY OF PROVISIONS : Section one of this bill amends subdivision 3 of section 467-b of the Real Property Tax Law by adding a new paragraph i which provides that the entity that administers the Senior Citizen Rent Increase Exemption Program (SCRIE) and the Disability Rent Increase Exemption Program (DRIE) has to develop informational material describing eligibility for and benefits of both these programs, and how more information can be obtained for these programs. This information must be provided to landlords of housing accommodations subject to the local emergency housing rent control act, the emergency tenant protection act of 1974, the emergency housing rent control law and the rent stabilization law of 1969.

GOLDEN -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the real property tax law, in relation to notifying certain tenants of the senior citizen rent increase exemption program and the disability rent increase exemption program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 467-b of the real property tax law is amended by adding a new paragraph i to read as follows: I. (1) THE ENTITY ADMINISTERING THE PROGRAM SHALL DEVELOP INFORMA- TIONAL MATERIAL DESCRIBING ELIGIBILITY FOR AND BENEFITS OF THE SENIOR CITIZEN RENT INCREASE EXEMPTION PROGRAM AND THE DISABILITY RENT INCREASE EXEMPTION PROGRAM ADMINISTERED PURSUANT TO THIS SECTION, AND, HOW ADDI- TIONAL INFORMATION CAN BE OBTAINED REGARDING THESE PROGRAMS. SUCH INFOR- MATIONAL MATERIAL SHALL BE PROVIDED TO LANDLORDS OF HOUSING ACCOMMO- DATIONS SUBJECT TO PROVISIONS OF THE LOCAL EMERGENCY HOUSING RENT CONTROL ACT, THE EMERGENCY TENANT PROTECTION ACT OF NINETEEN SEVENTY-FOUR OR ANY LOCAL LAWS ENACTED PURSUANT THERETO, THE EMERGENCY HOUSING RENT CONTROL LAW, AND THE RENT STABILIZATION LAW OF NINETEEN HUNDRED SIXTY-NINE. (2) A LANDLORD OF ANY HOUSING ACCOMMODATION SUBJECT TO PROVISIONS OF THE LOCAL EMERGENCY HOUSING RENT CONTROL ACT, THE EMERGENCY TENANT PROTECTION ACT OF NINETEEN SEVENTY-FOUR OR ANY LOCAL LAWS ENACTED PURSU- ANT THERETO, THE EMERGENCY HOUSING RENT CONTROL LAW OR THE RENT STABILI- ZATION LAW OF NINETEEN HUNDRED SIXTY-NINE SHALL, AT LEAST ONCE ANNUALLY, INCLUDING WITH A NEW LEASE AND ALL RENEWAL LEASES DELIVERED TO THE OCCU- PANT OF SUCH ACCOMMODATION, PROVIDE THE INFORMATIONAL MATERIAL DESCRIB- ING ELIGIBILITY FOR AND THE BENEFITS OF THE SENIOR CITIZEN RENT INCREASE EXEMPTION PROGRAM AND THE DISABILITY RENT INCREASE EXEMPTION PROGRAM, AS PROVIDED BY THE ENTITY ADMINISTERING THE PROGRAM PURSUANT TO SUBPARA- GRAPH ONE OF THIS PARAGRAPH.
