BILL NUMBER:S5939 REVISED MEMO 06/12/2015 TITLE OF BILL: An act to amend the public health law, in relation to continuing medical education on pain management, palliative care and addiction PURPOSE: To make technical amendments to S 4348 of 2015 including clarification that health care professionals authorized to prescribe controlled substances who are required to complete medical education on pain management, palliative care, and addiction do so prior to renewal of their license rather than every two years.. SUMMARY OF PROVISIONS: Section one makes technical amendments to § 3309-a of the PHL to clarify that rather than CME being required every two years it is required prior to renewal of registration to practice, which is not two years for all prescribers It also clarifies that the CME shall be deemed to count toward existing CME requirements for licensure not just toward a professional's obligation for board certification which not all prescribers have. HANNON -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the public health law, in relation to continuing medical education on pain management, palliative care and addiction THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The opening paragraph of subdivision 3 of section 3309-a of the public health law, as added by a chapter of the laws of 2015 amend- ing the public health law relating to the prescription pain medication awareness program, as proposed in legislative bills numbers S.4348 and A.355, is amended to read as follows: The commissioner, in consultation with the commissioner of education, shall establish standards, and review and implement requirements for the performance of continuing medical education on pain management, pallia- tive care and addiction. Every health care professional licensed, registered or certified under title eight of the education law to treat humans and registered under the federal controlled substances act and in possession of a registration number from the drug enforcement adminis- tration, United States Department of Justice, or its successor agency, shall, [every two years] PRIOR TO RENEWAL OF REGISTRATION TO PRACTICE, complete three hours of course work as set forth in this section; provided, however, that said hours shall be deemed to count toward the professional's obligation for board certification OR EXISTING CONTINUING EDUCATION REQUIREMENT FOR LICENSURE. S 2. This act shall take effect on the same date and in the same manner as a chapter of the laws of 2015 amending the public health law relating to the prescription pain medication awareness program, as proposed in legislative bills numbers S.4348 and A.355, takes effect, provided that the amendments to subdivision 3 of section 3309-a of the public health law, made by section one of this act, shall not affect the expiration and repeal of such subdivision, and shall expire and be deemed repealed therewith.
