TITLE OF BILL: An act authorizing the town of Brookhaven, Suffolk county to establish a special improvement district for a medical facility for the Fire Island Pines area of the town of Brookhaven

PURPOSE: This legislation would authorize the establishment of a special improvement district in the unincorporated Fire Island Pines area of the town of Brookhaven.

SUMMARY OF PROVISIONS: Section 1 of this bill is a special act to authorize the town board of the Town of Brookhaven to establish a special improvement district pursuant to article 12 or 12-A of the town law, to construct, reconstruct, repair, operate, equip and maintain a suitable building for a medical facility for the population of the unincorporated Fire Island Pines area of the town of Brookhaven, Suffolk county, New York, and to acquire by purchase, lease or gift necessary lands therefor. Notwithstanding the provisions of any law to the contrary, the town board of the town of Brookhaven may contract with a medical entity for the provision of emergency medical services to promote the health, safety and welfare of the residents and visitors of the Fire Island Pines area. The town board is authorized and empowered to appropriate the sums required to be paid under the terms of such contract.

Section 2 allows the town board certain authorities as it pertains to acquiring, building and maintaining real property or structure.

Section 3 states that costs and expenses approved by this act shall be assessed, levied, and collected from the lots and parcels located within the unincorporated Fire Island Pines area.

JUSTIFICATION: Fire Island Pines is a summer community with public beaches and a large public transient dock facility located on Fire Island. The only access to this area is by ferry or private boat. A helicopter is used in cases of a medical emergency. The property owners in the Fire Island Pines area are interested in establishing a special improvement district to ensure that Emergency Medical Services are readily available. All attendant costs would spread throughout the community. Such special improvement districts as this have been established elsewhere throughout the State, including Davis Park on Fire Island in 1990.

Pursuant to article 12 or 12-A of the town law, the town board of Brookhaven, Suffolk county, may establish a special improvement district to construct, reconstruct, repair, operate, equip and maintain a suitable building for a medical facility for the population of the unincorporated Fire Island Pines area of the town of Brookhaven, Suffolk county, New York, and to acquire by purchase, lease or gift necessary lands therefor. Notwithstanding the provisions of any law to the contrary, the town board of the town of Brookhaven may contract with a medical entity for the provision of emergency medical services to promote the health, safety and welfare of the residents and visitors of the Fire Island Pines area. The town board is authorized and empowered to appropriate the sums required to be paid under the terms of such contract. S 2. An expenditure authorized and approved pursuant to this act shall be assessed, levied and collected from the several lots and parcels of land within the special improvement district in the same manner and at the same time as other town charges. However, nothing contained herein shall be so construed to prevent the financing in whole or in part, by the town of Brookhaven on behalf of the special improvement district pursuant to the local finance law, of any expenditure enumerated in this act. S 3. This act shall take effect immediately.
