TITLE OF BILL:  An act to amend the vehicle and traffic law, in
relation to granting a waiver of the photo image fee charged for the
processing of certain license documents to veterans

PURPOSE:

To provide a waiver of the twelve dollars and fifty cent charge for
the processing of each license document for all veterans, combat and
non-combat related.

SUMMARY OF PROVISIONS:

Amends the vehicle and traffic law by amending section 503-f, which
establishes the twelve dollar and fifty cent fee charged for the
processing of each learner permit or license document requiring a
photo image, to read that any applicant who was a member of the armed
forces of the United States and received an honorable discharge shall
be granted a waiver of the initial photo image fee when applying for a
license, learner permit or non-driver photo ID card that indicates the
applicant's veteran status. The waiver of fees shall be applicable
only to the replacement of a non-veteran designated driver license
document to one which includes the veteran designation and shall not
be applicable to a regular renewal.

JUSTIFICATION:

In 2012, the legislature passed a measure allowing qualified U.S.
military veterans to obtain a New York State driver license with a
special veteran designation, thereby eliminating the need for veterans
to carry separate documentation proving their military service.
Although no additional fees are charged for the veteran status
designation, certain military veteran applicants that were issued
license documents prior to enactment of the law must pay the full
regular fee in order to obtain the new version of the driver license
which may now include the veteran designation, or wait until the
expiration of the document in order to request the veteran designation
at the next regular renewal.

This bill seeks to eliminate that photo fee for veterans. Veterans
have dedicated their time, energy and resources to this state and
country. By waiving this fee we are honoring their service and
allowing more veterans, including disabled veterans to take advantage
of the new veteran license designation.

AN ACT to amend the vehicle and traffic law, in relation to  granting  a
  waiver  of  the  photo image fee charged for the processing of certain
  license documents to veterans

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Paragraph (f) of subdivision 2 of section 503 of the vehi-
cle and traffic law, as amended by section 2 of part F of chapter 59  of
the laws of 2009, is amended to read as follows:
  (f) Photo image fee. (I) In addition to any other fee prescribed here-
in,  a  fee  of  twelve dollars and fifty cents shall be charged for the
processing of each learner permit or license document requiring a  photo
image.  Of  each  such fee collected, five dollars shall be deposited to
the credit of the general fund and five dollars shall  be  deposited  in
the  dedicated  highway  and  bridge  trust fund established pursuant to
section eighty-nine-b of the state finance law and  the  dedicated  mass
transportation  TRUST fund established pursuant to section eighty-nine-c
of the state finance law and distributed according to the provisions  of
subdivision (d) of section three hundred one-j of the tax law.
  (II)  Notwithstanding  any inconsistent provision of this section, the
difference collected between the fees set forth  in  this  paragraph  in
effect  on and after September first, two thousand nine and the fees set
forth in this paragraph in effect prior to such date shall be  deposited
to the credit of the dedicated highway and bridge trust fund.
  (III)  NOTWITHSTANDING ANY INCONSISTENT PROVISION OF THIS SECTION, THE
PHOTO IMAGE FEE SET FORTH IN THIS PARAGRAPH SHALL NOT BE CHARGED FOR THE
PROCESSING OF THE REPLACEMENT OF  A  LICENSE  DOCUMENT  WHICH  DOES  NOT
INCLUDE THE VETERAN DESIGNATION FOR A DOCUMENT WHICH INCLUDES THE VETER-
AN  STATUS  DESIGNATION PURSUANT TO PARAGRAPH (A-ONE) OF SUBDIVISION ONE
OF SECTION FIVE HUNDRED FOUR OF THIS ARTICLE.  THIS  SUBPARAGRAPH  SHALL
NOT APPLY TO REGULAR RENEWALS.
  S 2. This act shall take effect immediately.
