BILL NUMBER:S6000 TITLE OF BILL: An act to amend the elder law, in relation to rules and regulations pertaining to the operation of social adult day care programs PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to prevent duplicative state regulations from applying to social adult day programs. SUMMARY OF SPECIFIC PROVISIONS: This bill would amend section 215 of the Elder Law to specify that when there is duplication of regulation between the State Office for the Aging and another state agency with regards to social adult day care, the other state agency's regulations would take precedence. JUSTIFICATION: Our goal is to encourage adult day programs that provide appropriate and safe services. These programs form an important community level of care. However, we also want to avoid duplication of oversight efforts to reduce burdens on both the agencies and the programs. SAVINO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the elder law, in relation to rules and regulations pertaining to the operation of social adult day care programs THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The opening paragraph of paragraph (a) of subdivision 2 of section 215 of the elder law, as amended by a chapter of the laws of 2015 amending the elder law relating to rules and regulations pertaining to the operation of social adult day care programs, as proposed in legislative bills numbers S.3923 and A.5352, is amended to read as follows: The director is authorized and directed to promulgate rules and regu- lations, establishing standards and requirements with regard to the operation of all social adult day care programs, regardless of the source of funding utilized by such programs, whether public or private. FOR A PROGRAM SUBJECT TO OVERSIGHT BY THE OFFICE PURSUANT TO THIS SECTION AND ANY OTHER STATE AGENCY, WHERE THERE IS DUPLICATION IN THE RULES AND REGULATIONS PROMULGATED BY SUCH AGENCIES, THE RULES AND REGU- LATIONS OF THE OTHER STATE AGENCY SHALL TAKE PRECEDENCE. THE DIRECTOR SHALL ESTABLISH A METHOD BY WHICH A PROGRAM AFFECTED BY SUCH DUPLICATION OF RULES AND REGULATIONS SHALL NOTIFY THE OFFICE OF SUCH DUPLICATION. Such standards and requirements shall include, but not be limited to: S 2. This act shall take effect on the same date and in the same manner as a chapter of the laws of 2015 amending the elder law relating to rules and regulations pertaining to the operation of social adult day care programs, as proposed in legislative bills numbers S.3923 and A.5352, takes effect.
