Provides that surcharges imposed on ratepayer's utility bills for programs including the renewable portfolio standard shall not be allocated to assist persons whose facilities are located outside of the territorial limits of the United States of America and who also do not have facilities located within New York state.

BILL NUMBER:S6167 TITLE OF BILL: An act to amend the public service law, in relation to prohibiting allocation of certain surcharges on utility bills for foreign facilities who do not have facilities within New York state PURPOSE: To ensure that ratepayer surcharges mandated by the Public Service Commission (PSC) are not used to support electric generating facilities or energy related activities in foreign countries. SUMMARY OF PROVISIONS: Section 1: Creates a new section 18 of the Public Service Law that prohibits money collected from captive ratepayers through the Renewable Portfolio Standard, the Energy Efficiency Portfolio Standard, the System Benefit Charge or any other ratepayer funded utility collection from being used to support infrastructure or generating facilities that are located outside of the United States. Section 2: Sets forth the effective date JUSTIFICATION: State programs to support efficiency and renewable energy were mandated by the Public Service Commission (PSC) in order to spur a clean energy economy in New York. State, reduce pollution and enhance fuel diversity. All of these programs operate through fees imposed on ratepayers by the Commission. As such, it is imperative that each and

MAZIARZ, ADDABBO, LARKIN, O'MARA, RANZENHOFER, RITCHIE, YOUNG -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommunications AN ACT to amend the public service law, in relation to prohibiting allo- cation of certain surcharges on utility bills for foreign facilities who do not have facilities within New York state THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public service law is amended by adding a new section 18 to read as follows: S 18. RENEWABLE PORTFOLIO STANDARD SURCHARGES. NOTWITHSTANDING ANY LAW, RULE, REGULATION, POLICY OR ORDER TO THE CONTRARY, NO MONEY COLLECTED THROUGH, OR BENEFIT RESULTING FROM THE STATE'S COLLECTION OF, SURCHARGES IMPOSED ON RATEPAYER'S UTILITY BILLS FOR PROGRAMS INCLUDING BUT NOT LIMITED TO THE RENEWABLE PORTFOLIO STANDARD, THE SYSTEM BENEFITS CHARGE OR THE ENERGY EFFICIENCY PORTFOLIO STANDARD, EACH ESTABLISHED BY ORDER OF THE COMMISSION, SHALL BE ALLOCATED TO ASSIST PERSONS WHOSE FACILITIES ARE LOCATED OUTSIDE OF THE TERRITORIAL LIMITS OF THE UNITED STATES OF AMERICA AND WHO ALSO DO NOT HAVE FACILITIES LOCATED WITHIN NEW YORK STATE; PROVIDED, HOWEVER, THAT, FOR THE PURPOSES OF THE RENEWABLE PORTFOLIO STANDARD, NO SUCH MONEY OR BENEFITS SHALL BE ALLOCATED TO SUCH PERSONS WHO ALSO DO NOT HAVE RENEWABLE ENERGY ELECTRIC GENERATING FACIL- ITIES LOCATED WITHIN NEW YORK STATE.
