TITLE OF BILL: An act to amend the general municipal law, in relation to the public oversight of special districts
PURPOSE OR GENERAL IDEA OF BILL: To increase the public oversight of special districts by making the budgets of such special districts subject to public hearings by the governing body of the municipality that is authorized to adopt it.
SUMMARY OF SPECIFIC PROVISIONS: Section 1. General municipal law is amended by adding a new section 25.
Section 25 - 1. Makes the budget for a special district the subject of a public hearing by the governing body of the municipality that is authorized to adopt it, and mandates that the governing body vote on such budget at a public meeting. 2. Outlines the financial information that shall be included in such budget. 3. Mandates that the budget be completed at least seven days before the public hearing at which it is to be presented. 4. Whenever a governmental audit of a special district is conducted the governing body of the municipality authorized to adopt the budget of such district shall conduct a public hearing to review the findings of the audit within 60 days of the public release of the audit. 5. The chief fiscal officer of such special district and municipality shall be present to answer questions at any public hearing conducted pursuant to this section.
Section 2. Effective Date.
JUSTIFICATION: Special districts are a vital part of local government in all areas of New York State. However, with such responsibility comes the need for oversight. This legislation would put necessary oversight provisions into place to ensure public accountability in all special districts.

SUCH BUDGET SHALL BE COMPLETED AT LEAST THIRTY DAYS BEFORE THE PUBLIC HEARING AT WHICH IT IS TO BE PRESENTED, OR EARLIER AS PROVIDED BY LAW, AND SHALL BE MADE AVAILABLE, UPON REQUEST AND AT THE OFFICES OF THE SPECIAL DISTRICT AND MUNICIPALITY, AND AT ANY PUBLIC LIBRARY OR FREE ASSOCIATION LIBRARY WITHIN THE DISTRICT, AND ON THE INTERNET WEBSITES OF THE SPECIAL DISTRICT AND THE MUNICIPALITY, IF SUCH WEBSITES EXIST. 4.
